RES 2026-83 Approving a Preliminary Plat and Final Plat MAK Otsego AdditionCITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA RESOLUTION NO: 2026-83 APPROVING A PRELIMINARY PLAT AND FINAL PLAT MAK OTSEGO ADDITION WHEREAS, MAK Properties, LLC ("Developer") has submitted application for a preliminary plat and a final plat; and WHEREAS, the legal description of the subject property ("Property") is attached as Exhibit A; and WHEREAS, the Property is within the West Sewer District and guided for future Industrial land uses by the 2023 Comprehensive Plan; and WHEREAS, the subject property is zoned A-1, Agriculture Rural Service District; and WHEREAS, the Developer is requesting approval of a Preliminary Plat and a Final Plat to be known as MAK Otsego Addition ("Plat") for subdivision the Property into four lots; and WHEREAS, an application for preliminary plat approval is processed in accordance with the provisions of Section 10-5-2 of the Subdivision Ordinance; and WHEREAS, Section 10-5-3.A.3 of the Subdivision Ordinance allows for processing of an application for final plat approval concurrent with a request for preliminary plat approval. WHEREAS, an application for final plat approval is processed in accordance with the provisions of Section 10-5-3 of the Subdivision Ordinance; and WHEREAS, Section 10-5-3.A.3 of the Subdivision Ordinance allows for processing of an application for final plat approval concurrent with a request for preliminary plat approval. WHEREAS, the Planning Report dated 16 September 2026 prepared by the City Planner, The Planning Company LLC, is incorporated herein; and WHEREAS, the Planning Commission conducted a public hearing at their regular meeting on 21 September 2026 to consider the application, preceded by published and mailed notice; based upon review of the application and evidence received, the public hearing was closed and the Planning Commission recommended by a 7-0 vote that the City Council approve the request based on the aforementioned findings; and WHEREAS, the Request for Council Action dated 28 September 2026 prepared by the City Planner, The Planning Company LLC, is incorporated herein; and WHEREAS, the City Council considered the applications at its meeting on 28 September 2026. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OTSEGO, MINNESOTA THAT the MAK Otsego Addition Preliminary Plat and Final Plat are approved based upon the foregoing information and applicable ordinances, subject to the following conditions: 1 Approval of the preliminary plat shall not guarantee access to sanitary sewer service. The City shall allocate sanitary sewer capacity only to approved final plats with signed development contracts to assure the City of timely development. Uses occupying the subject property shall include those permitted uses allowed within the A-1 District or those conditional or interim uses subject to approval of the applicable zoning application. 3. The preliminary plat and final plat shall be revised to the outlot currently identified as Outlot D as Outlot B, and to redesignate Outlot B and Outlot C accordingly. 4. Right-of-way dedication shall be subject to review and approval by the City Engineer. 5. All grading, drainage, and erosion control plans are subject to review and approval of the City Engineer. 6. Utility Availability Charges for outlots shall be paid based on the City Fee Schedule in effect at the time of platting as lots and blocks. 7. Temporary drainage and utility easements shall be dedicated over Outlot B and Outlot C as currently shown on the preliminary plat and final plat, subject to review and approval by the City Engineer. 8. Outlot A shall be conveyed to the City by warranty deed free and clear of any and all encumbrances for stormwater management purposes. 9. Outlot D shall be conveyed to the City by warranty deed free and clear of any and all encumbrances. 10. Outlot A shall provide sufficient area for a greenway corridor trail outside of wetlands and required wetland buffers, subject to review and approval by the City Engineer. 11.
