The subject property is within the West Sewer District established by the 2023 Comprehensive Plan but City sewer utilities are not available at the property. To allow for preliminary stockpile of fill and grading of the property necessary for future development, the developer is requesting approval of a preliminary plat and final plat to subdivide the subject property into three outlots. The Planning Commission will consider the proposed subdivision at a public hearing noticed for 21 September 2026. Exhibits: §Site Location Map §Preliminary Plat §Final Plat (2 sheets) ANALYSIS Comprehensive Plan. The subject property is guided for industrial uses by the Future Land Use Plan map of the 2023 Comprehensive Plan. Preparation of the site for future industrial development with subdivision into outlots intended to be platted as lots and blocks and preliminary grading, is consistent with the Future Land Use Plan. 2 Zoning. The subject property is zoned A-1, Agriculture Rural Service District. Future development would require rezoning to I-2, General Industrial District, which provides for locations with office, storage, processing, assembly, compounding, warehousing and similar uses. The Interim Land Use Plan policies of the 2023 Comprehensive Plan stipulate that properties are only to be rezoned at such time as necessary infrastructure is available. Because City sewer utilities are not available at the property, a rezoning action would be premature. The proposed subdivision of the subject property as outlots can occur under the provisions of the A- 1 District, with the outlots being rezoned to I-2 District when platted as lots and blocks when City sewer utilities are available to allow for development consistent with the Interim Land Use Plan. Surrounding Uses. The subject property is surrounded by the following existing and planned land uses: Direction Land Use Plan Zoning Map Existing Use North Industrial A-1 District Cultivated fields East Industrial I-2 District Bury Industrial Park I-94 West Industrial Park South Public INS District MnRoad West Public Industrial INS District A-1 District MnRoad Wright Co. Highway Lot Requirements. Lots within the I-2 District are required to be a minimum of 2.0 acres in area with a minimum width of 200 feet by Section 11-86-6 of the Zoning Ordinance. Outlots are not subject to minimum area and width requirements because they are deemed unbuildable parcels. However, both Outlot B and Outlot C as shown on the preliminary plat and final plat exceed the minimum area requirement and have more than the minimum frontage to a public street to allow for future platting as buildable lots. Setbacks. The table below states the required setbacks applicable to the lot as established by Section 11-86-7 of the Zoning Ordinance. Both Outlot B and Outlot C as shown on the preliminary plat and final plat have sufficient area within the required building envelope to allow for development of future principal uses. ROW Side Rear Required 30ft. 20ft. 25ft. Access. Outlot B and Outlot C have frontage to allow access to 70th Street and Jalger Avenue. The Transportation Plan of the 2023 Comprehensive Plan designates these streets as Commercial/Industrial Major Collector Streets. The right-of-way abutting the subject property is 100 feet in width, which is sufficient. Access to 70th Street and Jalger Avenue is allowed in accordance with Section 11-21-6 of the Zoning Ordinance, subject to review and approval by the City Engineer. 3 Utilities. No utility plan has been submitted for the preliminary plat and final plat. City sewer is not available to the subject property as it must be extended from Kadler Avenue through the wetlands to the northeast of the subject property. City water is available at the plat line. Outlot B and Outlot C cannot be platted as lots and blocks until such time as City sewer is available. Payment of Utility Availability Charges for the subject property are deferred until Outlot B and Outlot C are platted as lots and blocks and will be charged based on the City Fee Schedule in effect at that time. Grading Plan. Plans for grading, erosion control, and stormwater management will be required for future development of the subject property no later than application to plat lots and blocks. The developer is proposing to stockpile fill material and undertake preliminary grading of the subject property prior to platting lots and blocks. A grading and erosion control plan will be required for the preliminary grading work. All grading, drainage and erosion control issues are to be subject to review and approval by the City Engineer. The developer will be required to execute an administrative grading agreement with the City to provide for necessary security and administration of the interim stockpiling and grading of the subject property. Easements. Section 10-8-12 of the Subdivision Ordinance establishes requirements for drainage and utility easements to be dedicated with the proposed final plat. These easements include the perimeter of all lots, over any in-ground utilities, or overland drainageways. The required drainage and utility easements are illustrated on the final plat as required by the Subdivision Ordinance. However, as the subject property is being proposed as outlots, City staff recommends that no permanent drainage and utility easements be dedicated with the final plat, but that temporary drainage and utility easements that expire upon platting of the outlots as lots and blocks be established by document. All drainage and utility easements are subject to review and approval by the City Engineer. Park Dedication. The Future Parks and Trails Plan map of the 2023 Comprehensive Plan identifies a greenway corridor trail being extended through Outlot A between 70th Street/Jalger Avenue and the Northeast corner of the subject property. The area of Outlot A is subject to review by the City Engineer to ensure sufficient area is provided for this greenway trail outside of the wetlands and required wetland buffer. Park dedication fees for Outlot B and Outlot C will be required at the time each outlot is platted as a lot and block based on the City Fee Schedule then in effect. Development Contact. Section 10-10-4.A of the Subdivision Ordinance requires execution of a Development Contract with final plat approval to provide for completion of public improvements, establishment of required securities, and payment of applicable fees related to the subdivision of the subject property. There are no public improvements proposed with the final plat of the outlots. As such, no Development Contract is required. 4 RECOMMENDATION City staff recommends approval of the MAK Addition establishing outlots to facilitate future platting of industrial development subject to the conditions outlined below. POSSIBLE ACTIONS Motion to recommend approval of a preliminary plat and final plat for MAK Addition, subject to the following conditions: 1.
