RESOLUTION NO: 2026-63
APPROVING A CIC PLAT FOR
HEGGEM 1-94 WEST INDUSTRIAL CONDOMINIMUM
WHEREAS, the City Council approved site and building plans on 23 June 2025 for the property legally described by Exhibit A
("Property"); and
WHEREAS, developer Acuity Land Holding, LLC ("Developer") has submitted application for approval of a Common Interest
Community plat to subdivide the building units for individual ownership; and
WHEREAS, the Common Interest Community plat is subject to the provisions of the City Code in accordance with Minnesota
Statutes 51513.1-106; and
WHEREAS, the application for approval of a Common Interest Community plat is processed in accordance with Section 10-5-
4 of the Subdivision Ordinance; and
WHEREAS, the City Council considered the application at its meeting on 10 August 2026; and
WHEREAS, the Request for City Council Action dated 10 August 2026 prepared by the City Planner, The Planning Company
LLC, is incorporated herein.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OTSEGO, MINNESOTA:
1. The Heggem 1-94 West Industrial Condominium plat is hereby approved.
2. The required declaration and bylaws prepared in accordance with Minnesota Statutes 515E shall be subject to review
and approval of the City Attorney.
3. The Common Interest Community plat shall be recorded within 60 days of City Council approval.
