RES 2026-53 Adopting Findings of Fact and Approving a Conditional Use Permit for South Centeral Water Treatment PlatCITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA RESOLUTION NO: 2026-53 ADOPTING FINDINGS OF FACT AND APPROVING A CONDITIONAL USE PERMIT FOR SOUTH CENTRAL WATER TREATMENT PLANT. WHEREAS, the City of Otsego ("City") has prepared plans for construction of a drinl<ing water treatment plant to be Known as the South Central Water Treatment Plant ("SC-WTP"); and WHEREAS, the legal description of the subject property ("Property") is attached as Exhibit A; and WHEREAS, the Property is within the Urban Service Expansion Area E4 and guided for future Industrial land uses by the 2023 Comprehensive Plan; and WHEREAS, the subject property is zoned A-1, Agriculture Rural Service District; and WHEREAS, the City is proposing amendment of the Zoning Map to designate the Property as INS, Institutional District; and WHEREAS, a proposal for a Zoning Map amendment is processed in accordance with the provisions of Section 11-3-2 of the Zoning Ordinance; and WHEREAS, City utility facilities are allowed in the INS District as a conditional use; the City is proposing issuance of Conditional Use Permit for the SC-WTP; and WHEREAS, a proposal to issue a Conditional Use Permit is processed in accordance with the provisions of Section 11-4-2 of the Zoning Ordinance; and WHEREAS, the City Council must tal<e into consideration the possible effects of the Zoning Ordinance amendment and conditional use with their judgment based upon (but not limited to) the criteria outlined in Section 11-3-2.F and Section 11-4-2.F of the Zoning Ordinance, respectively: The proposed action's consistency with the specific policies and provisions of the Otsego Comprehensive Plan. Finding: A goal of the 2023 Comprehensive Plan is that costs incurred for the provision of all municipal utilities and services shall be financed by those who receive such service. This is implemented through the policy of reducing the risk of payment for the provision of the utility system by non -users through utility phasing, the identification of potential water revenue sources, establishment of realistic growth expectations, and adoption of a Capital Improvement Plan. The planned construction of the SC-WTP is consistent with the Capital Improvement Plan, Water System Master Plan, and 2023 Comprehensive Plan. 2. The proposed use's compatibility with present and future land uses of the area. Finding: Properties to the north, east, south, and west are all used for cultivated fields. There are scattered rural residential dwellings in the area and a planned urban residential subdivision to the southwest. Future uses to the east and south of the subject property are planned for industrial uses while areas to the west across McAllister Avenue and north across 70rh Street (CSAH 38) are planned for future residential development. The operation of the SC-WTP will not affect the existing or planned use of surrounding properties. 3. The proposed use's conformity with all performance standards contained within the Zoning Ordinance and other provisions of the City Code. Finding: The proposed SC-WTP will comply with the applicable requirements of the Zoning Ordinance, Subdivision Ordinance, and City Code, 4. Traffic generation of the proposed use in relation to capabilities of streets serving the property. Finding: The SC-WTP is accessed via a City street to be improved to Commercial/Industrial Collector Street standards that will have capacity to accommodate traffic generated by the use. The proposed use can be accommodated by existing public services and facilities and will not overburden the City's service capacity. Finding: The City has planned for development of the SC-WTP to provide increased water quality and sustainability of the water utility system in accordance with the Comprehensive Plan. WHEREAS, the Planning Report dated 10 June 2026 prepared by the City Planner, The Planning Company LLC, is incorporated herein. WHEREAS, the Planning Commission conducted a public hearing at its regular meeting on 15 June 2026 to consider the proposals, following published and mailed notice; based upon review of the application and evidence received, the public hearing was closed and the Planning Commission recommended by a 6-0 vote that the City Council approve the request based on the aforementioned findings; and WHEREAS, the City Council considered the proposals at its meeting on 13 July 2026. NOW, THEREFORE, BE IT RESOLVED BYTHE OTSEGO CITY COUNCIL THAT the findings of fact outlined herein are adopted and the proposed Zoning Map amendment and Conditional Use Permit are approved based upon the foregoing information and applicable ordinances, subject to the following conditions: The subject property shall be developed in accordance with the site and building plans submitted to the City subject to the stipulations, limitations, and conditions as approved by the City Council in accordance with Section 11-9-4 of the Zoning Ordinance. All exterior lighting shall comply with Section 11-16-6 of the Zoning Ordinance, subject to review and approval of the Zoning Administrator. 3. All signs shall be subject to review and approval of the Zoning Administrator. 4. All stormwater management issues shall be subject to review and approval of the City Engineer. All utility issues shall be subject to review by the City Engineer, Utilities Department, and Building Official.
