No No BACKGROUND/JUSTIFICATION: Tracy Defrance owns the property located at 5886 Rawlings Avenue. The property is a riparian lot along the Crow River developed with an existing single family dwelling constructed in 1965. The lot is non-conforming as the lot width is less than 1.0 acres as required by the Zoning Ordinance for lots within the A-1, Agriculture Rural Service District. The physical characteristics of the lot also include steep bluffs from the house site down to the Crow River with an elevation change of approximately 16 feet. The single family dwelling is served by a private on-site well and Subsurface Sewage Treatment System. The property owner is proposing to remove the Subsurface Sewage Treatment System and connect to City sewer utilities; water service would continue to be provided by the existing on-site well. A sewer forcemain was constructed with the plat of Meadows of Riverpoint between Rathburn Avenue and Rawlings Avenue (CSAH 36) that the subject property can connect to. Water utilities are located approximately 1,200 feet to the south of the subject property at the intersection of 55th Street and Rawlings Avenue (CSAH 36). Section 8-1-3 of the City Code requires connection to both City sewer and water utilities when available to the property. Because of the distance of the nearest water line from the subject property, it is not feasible to connect to that utility at this time. Section 8-2-1.F of the City Code allows the City Council to approve an exception to the requirement to connect to City water under such circumstances. City staff has drafted a resolution to approve connection of the property to City sewer without connection to City water utilities. The property owner will be required to provide plans for connection to City sewer for review and approval of the City Engineer. The City Engineer will inspect the connection to the sewer forcemain. A building permit will also be required for the physical connection to the house plumbing system. Because the sewer line will cross under Rawlings Avenue (CSAH 36), a right-of-way permit is required from Wright County. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Otsego that the request to connect to City sewer only is approved based upon the foregoing information and applicable ordinances, subject to the following conditions: 1. Plans shall be submitted for connection to City sewer utilities, subject to review and approval by the City Engineer. 2. A building permit shall be required for connection of City sewer utilities to the single family dwelling, subject to review and approval by the Building Official. 3. Connection to City sewer utilities shall require payment of Sewer Availability Charges and Sewer Connection Fees for one Residential Equivalent Connection in accordance with the Fee Schedule in effect at the time a building permit is issued. 4. The property owner shall obtain approval of right-of-way permit issued by Wright County prior to construction of the sewer utility connection.
