The subject property is 12.12 acres located north of 70th Street and east of Kadler Avenue. The proposed development consists of 43 single family lots. The proposed subdivision requires applications for a Zoning Map amendment, a PUD Development Stage Plan, and a preliminary plat. The applications are subject to review by the Planning Commission and approval of the City Council. A public hearing to consider the zoning and subdivision applications has been noticed for the Planning Commission meeting on 15 June 2026. The subject property is zoned A-1, Agriculture Rural Service District. The proposed subdivision requires consideration of a Zoning Map amendment to rezone the subject property to PUD, Planned Unit Development District. The PUD District is to be based upon the uses and standards established for the residential Zachman Meadows preliminary plat by Ordinance 2024-05 adopted 22 April 2024. The Zoning Map amendment is to be considered based upon, but not limited to, the criteria established by Section 11-3-2.F of the Zoning Ordinance, respectively: 1. The proposed action's consistency with the specific policies and provisions of the Otsego Comprehensive Plan. Comment: The proposed development is consistent with the 2023 Comprehensive Plan, including the following policies: § Cluster land complementary uses and activities into functionally related sub-units of the community as determined by physical barriers, homogeneous land use characteristics, and service area boundaries. § Accomplish transitions between different land uses in an orderly manner so as not to create negative impacts on adjoining developments; changes in types of land use shall occur either at mid- block points, so that similar uses front on the same street, or at borders of areas separated by physical barriers. § Recognize the need to develop a variety of twin homes, townhouses, and multiple family dwellings to supplement conventional single family homes giving due consideration to local market demands and desired community character. 2. The proposed use's compatibility with present and future land uses of the area. Comment: The proposed development continues the land use pattern from Kittredge Crossings west through Windsong to Kadler Avenue with density increasing toward Kadler Avenue. The proposed residential uses are separated from existing and planned industrial uses to the north and west by wetland areas and Kadler Avenue, respectively, to provide necessary transition. 3 3. The proposed use's conformity with all performance standards contained within the Zoning Ordinance and other provisions of the City Code. Comment: The proposed development will comply with the requirements of the Zoning Ordinance, Subdivision Ordinance, and City Code including those provisions established as part of the PUD District. 4. Traffic generation of the proposed use in relation to capabilities of streets serving the property. Comment: The property is accessed by existing Minor Arterial and Commercial/Industrial Collector streets that have capacity to accommodate the traffic generated by the proposed development. 5. The proposed use can be accommodated by existing public services and facilities and will not overburden the City's service capacity. Comment: The proposed development is located within the West Sewer District and includes land uses consistent with the Future Land Use Plan. The City has adequate capacity to serve the proposed development. EAW. An Environmental Assessment Worksheet was prepared in accordance with Minnesota Rules 4410.4300 to evaluate the potential environmental effects of the initial Zachman Meadows and Condo Suites Otsego development; the subject property was included in this environmental review. The EAW document was noticed on 11 March 2025 and published by the Environmental Quality Board (EQB) and distributed to stakeholders and agencies identified by the EQB on 18 March 2025. At its meeting on 28 April 2025, the City Council adopted Findings of Fact, Conclusions, and Response to Comments and determined that the development did not have the potential for significant environmental effects, and that preparation of an Environmental Impact Statement was not required. Kadler Avenue. The property abuts Kadler Avenue, which the 2023 Transportation Plan designates as a Commercial/Industrial Collector Street. The Transportation Plan further identifies Kadler Avenue as a future Minor Arterial and possible Wright County roadway between 70th Street (future CSAH 38) and 95th Street (CSAH 39). The City has required dedication of 75 feet for one-half the right-of-way from developments abutting Kadler Avenue to allow for future expansion of the roadway consistent with Minor Arterial standards. The preliminary plat illustrates dedication of 75 feet wide right-of-way for the east half of Kadler Avenue abutting the subject site. One access is proposed to Kadler Avenue at the northwest corner of the preliminary plat. The proposed access aligns with the north driveway access to the Dakota Supply Group lot on the west side of Kadler Avenue to avoid conflicts with turning vehicles. Section 10-8-5.B.4.c of the Subdivision Ordinance requires a minimum of 500 feet between local street intersections to 4 Kadler Avenue based on its designated functional classification. The proposed access from the preliminary plat to Kadler Avenue is 1,050 feet from Kittredge Parkway to the south and 950 feet from future 77th Street to the north. The proposed access spacing complies with the provisions of the Subdivision Ordinance. Local Streets. Lots are to be accessed via local public streets internal to the preliminary plat with connections at Kadler Avenue, Kaeding Avenue, and Kagen Avenue. The local streets are designed with 60 foot rights-of-way as required by Section 10-8-5.B.1 of the Subdivision Ordinance and a 28 foot wide street section with a sidewalk on one side, as outlined by the Engineering Manual. There are no cul-de-sac streets within the proposed preliminary plat. Street names will be assigned by City staff in accordance with the Wright County grid system and Section 10-8-5.B.13 of the Subdivision Ordinance. Section 8-8-4 of the City Code specifies installation of street lighting for new subdivisions at the corners of intersecting streets and midblock locations for blocks longer than 900 feet. Street lighting is to be shown on the utility plan. All street design and construction plans and signs are subject to review and approval of the City Engineer. Blocks. Section 10-8-3.A of the Subdivision Ordinance establishes that blocks within a subdivision are to be a minimum of 300 feet and not more than 1,200 feet in length. The three blocks within the preliminary plat comply with the minimum and maximum length requirements established by the Subdivision Ordinance. Lot Requirements. The Zachman Meadows PUD District allows for single family lots having a minimum average area of 5,000 square feet and minimum width of 40 feet based on single family villa style homes. The average lot area within the preliminary plat is 6,717 square feet and all the proposed single family lots are at least 40 feet wide with additional width for corner lots to meet setback requirements from the street abutting the side lot line. The preliminary plat complies with the minimum lot requirements of the Zachman Meadows PUD District. Setbacks. The table below outlines minimum setbacks required for the preliminary plat by the Zachman Meadows PUD District: Kadler Avenue Local ROW Side Rear Required 65ft. House 25ft. Garage 30ft. 7ft. 20ft. Proposed 30ft. 25ft. Interior 7ft. Corner 15ft. Block 2: 15ft. Other: 20ft. 5 The rear yard setback from Kadler Avenue required by the PUD District is reduced from 65 feet to 30 feet based on the difference in right-of-way dedication for a Commercial/Industrial Collector Street versus that required for a potential future Minor Arterial/County Road. Because there is no established timeline for whether Kadler Avenue will be upgraded to a Minor Arterial, the effective setback between the homes and the existing street would be the same as if a 65 foot setback were required. Landscaping. Section 11-19-2.B.2 of the Zoning Ordinance requires that two shade trees be provided for each lot, one of which must be in the front yard, at the time of house construction. The front yard trees are required to be planted outside of public right-of-way. Section 11-19-3.B requires that lots abutting collector and arterial streets provide a landscape buffer yard. The submitted landscape plan includes the buffer yard plantings with the required size and number of plants and appropriate plant types for the lots within Block 3 subject to the buffer yard landscape requirement. Stormwater Management. The developer has submitted grading, drainage, and erosion control plans for development of the preliminary plat. Portions of the property are within the 100-Year Floodplain. The grading plan addresses filling areas of the floodplain and provides mitigation for additional flood storage. The developer has also submitted a wetland delineation for the proposed preliminary plat. Wetlands to be preserved are required by Section 11-16-5.F of the Zoning Ordinance to be protected by a 20 foot buffer with the wetland and wetland buffer platted within an outlot deeded to the City. All grading, drainage, wetland impacts, and erosion control issues are subject to review and approval of the City Engineer. Utilities. The subject property is within the West Sewer District with sewer and water utilities available at the south line of the preliminary plat. The developer has submitted plans for extension of sewer and water utilities to serve the proposed lots within the preliminary plat. The sewer extension includes additional depth and/or capacity necessary to function as a trunk facility serving areas west of Kadler Avenue. The developer will receive credit for the cost of the trunk portion of the sewer improvements against Sewer Availability Charges. All utility plans and trunk credits are subject to review and approval of the City Engineer. Easements. Section 10-18-12.A of the Subdivision Ordinance requires 10 foot drainage and utility easements at the perimeter of all lots (overlying side lot lines), as well as over any stormwater management facilities, wetlands, and wetland buffers not platted within outlots deeded to the City. The preliminary plat provides for dedication of required easements, which are to be subject to review and approval of the City Engineer. Outlots. The preliminary plat includes Outlot A, which overlays that portion of a creek, floodplain, wetlands, and wetland buffers within the subject property. The stormwater basin at the rear of the lots within Block 1 should also be platted in an outlot to be deeded to the City for stormwater management purposes in accordance with Section 10-8-12.D of the Subdivision Ordinance. 6 Park Dedication. Section 10-8-15.A of the Subdivision Ordinance requires subdividers to dedicate a reasonable portion of the buildable land within a proposed preliminary plat for public use as parks or open space. The City may also choose to accept an equivalent amount in cash for part or all the land required to be dedicated. The subject property is within the service area for Kittredge Park to the east. The Future Parks and Trails Map identifies a future Greenway corridor adjacent to the creek along the north line of the subject property. Due to the limited depth of the subject property between the Zachman Meadows plat and the creek, there is not sufficient space to accommodate the Greenway corridor on the south side of the creek. The needed area for the Greenway corridor will have to be acquired from the property to the north. City staff has discussed the possibility that the developer could acquire and dedicate a drainage and utility easement, as well as a trail easement for the Greenway corridor, over the creek, floodplain, wetlands, and wetland buffers on the parcel to the north with the trail easement being credited for park dedication. This matter is still under discussion between City staff and the developer and will need to be determined prior to final plat approval. If dedication of land in the form of drainage and utility and trail easements is not agreed upon, payment of a cash fee in lieu of land for each single family lot will be required based on the fee in effect at the time the development contract is executed. Development Contract. Section 10-10-4.A of the Subdivision Ordinance requires execution of a Development Contract with final plat approval to provide for completion of public improvements, establishment of required securities, and payment of applicable fees related to the subdivision of the subject property. Development fees required to be paid based on the fee schedule in effect at the time the development contract is executed include, but are not limited to, the following: • Water Availability Charge • Sewer Availability Charge (less trunk credits) • Otsego Creek Stormwater Impact Fee • Park fee in lieu of land dedication Payment of Utility Connection Fees is due at the time a building permit is issued for each lot in accordance with Title 6, Section 1 of the City Code. The City Attorney will draft a PUD Agreement and Development Contract addressing the subdivision improvements for approval by the City Council concurrent with the final plat. 7 RECOMMENDATION The proposed Zachman Meadows 2nd Addition PUD Development Stage Plan and preliminary plat are consistent with the goals and policies of the 2023 Comprehensive Plan. The proposal also complies with the requirements of the Zachman Meadows PUD District, the Zoning Ordinance, and the Subdivision Ordinance. Accordingly, City staff recommends approval of the applications subject to the conditions outlined below. POSSIBLE ACTIONS Motion to recommend approval of a Zoning Map amendment rezoning the subject property to PUD District and approval of a PUD Development Stage Plan and preliminary plat of Zachman Meadows 2nd Addition, subject to the following conditions: 1. Approval of the preliminary plat shall not guarantee access to sanitary sewer service. The City shall only allocate sanitary sewer capacity to approved final plats with signed development contracts to assure the City of timely development. 2. All right-of-way dedication, street design and construction plans, sidewalks, street lighting and street names shall be subject to review and approval of the City Engineer. 3. All lots within the preliminary plat shall comply with the following setbacks: Kadler Avenue Local ROW Side Rear Proposed 30ft. 25ft. Interior 7ft. Corner 15ft. Block 2: 15ft. Other: 20ft. 4. Two shade trees shall be planted upon each lot by the builder, one of which shall be in the front yard. 5. Residential buffer yard landscaping shall be planted by the developer within Block 3 as required by the Zoning Ordinance, subject to review and approval of the Zoning Administrator. 6. All grading, drainage, floodplain, wetland, and erosion control issues shall be subject to review and approval of the City Engineer. 7. A Stormwater Impact Fee for Otsego Creek shall be paid by the developer in accordance with the fee in effect upon execution of the development contract. 8. All utility plans shall be subject to review and approval of the City Engineer. 9. Utility Availability Charges shall be paid by the developer in accordance with the fee in effect upon execution of the development contract. 8 10. Utility Connection Fees shall be paid by the developer at the time a building permit is issued for each lot in accordance with the City Code and fee schedule in effect. 11. All drainage and utility easements shall be subject to review and approval of the City Engineer. 12. The preliminary plat shall be revised to encompass the stormwater basin within an outlot to be designated as Outlot B, subject to review and approval of the City Engineer. 13. Outlot A and Outlot B shall be deeded to the City for stormwater management purposes. 14. Park dedication requirements shall be satisfied as payment of a cash fee in lieu of land in accordance with the fee in effect upon execution of the development contract, unless an agreement is reached to dedicate land subject to approval of the City Council. 15. A PUD Agreement and Development Contract as drafted by the City Attorney and approved by the City Council shall be executed by the developer. 16. The final plat shall be recorded within one year of City Council approval unless an extension is approved by the City Council. c. The proposed development includes single-family homes that expand off the first mixed use addition to the south. This 12.12-acres site is a follow up to the EAW that was completed in April of 2025 for the entire Zachman Meadows development. We are excited about the improvements proposed for this site. Development Plan Rezoning We intend to develop the site as part of the existing PUD to the south and would need to have the parcel rezoned to PUD to match the standards for the 1st addition. The development will comply with all performance standards contained in the Zoning Ordinance except where specific flexibility has been granted by the existing PUD to the south. 4. Traffic generation of the proposed use in relation to capabilities of streets serving the property. The property is bounded by Kadler Avenue on the west (a future major collector) and 70th Street NE on the south (a future major arterial). These streets will accommodate the traffic anticipated by this development. 5. Preliminary Plat The preliminary plat shows 43 single family lots that build off the temporary cul-de-sacs of both Kagen Avenue and Kaeding Lane. The roads will connect as the “new“ section of 75th Street that will have an additional access onto Kadler Ave that matches with the industrial drive access across from it. The single-family lots have sizes ranging from 4,577 sq. ft. to 9,881 sq. ft. with an average of 6,717 sq. ft. for the entire addition. The development meets the standards found in the Zoning Ordinance except for the flexibility that is allowed in the existing PUD that this would be included in if rezoned. The Operator shall minimize the exposure to stormwater of any of the products, material, or wastes stored on site that may wash downstream or contaminate stormwater. Building products that have the potential to leach pollutants must be under cover. Chemicals and landscape materials shall be under cover to prevent the discharge of pollutants. Operator to track progress of the following items on site maps: portable toilets, material storage areas, vehicle and equipment fueling and maintenance areas, concrete washouts, paint and stucco washouts, dumpsters or other trash and debris containers, spill kits, stockpiles, any other non-structural non-storm water management BMPs, any temporarily removed structural BMPs, any changes to the structural BMPs. Solid waste: collected sediment, asphalt and concrete millings, floating debris, paper, plastic, fabric, construction and demolition debris and other wastes must be disposed of properly and must comply with MPCA disposal requirements. Hazardous waste: oil, gasoline, paint and any hazardous substances must be properly stored in sealed containers to prevent spills, leaks or other discharge. Restricted access to storage areas must be provided to prevent vandalism. Storage and disposal of hazardous waste or materials must be in compliance with Minn. R. Ch. 7045 including secondary containment as applicable. Portable toilets must be positioned so that they are secure and will not be tipped or knocked over. Concrete and other washout waste: operator must provide effective containment for all liquid and solid wastes generated by washout operations. The liquid and solid wastes must not contact the ground, and the containment must be designed so that it does not result in runoff from the washout operations or areas. Liquid and solid wastes must be disposed of properly and in compliance with MPCA rules. A sign must be installed adjacent to each washout facility that requires site personnel to utilize the proper facilities for disposal of concrete and other washout wastes. External vehicle washing: external washing of trucks and other construction vehicles must be limited to a defined area of the site. Runoff must be contained and waste properly disposed of. No engine degreasing is allowed on site. Operator shall take reasonable steps to prevent the discharge of spilled or leaked chemicals, including fuel, from any area where they will be loaded or unloaded as detailed in the Permit. Minimize Disturbed Areas and Protect Natural Features and Soil Appropriate construction practices (e.g. construction phasing, vegetative buffer strips, horizontal slope grading) shall be used to minimize erosion. Areas not to be disturbed (buffers, etc.) shall be protected with construction or silt fence before work begins. Operator shall develop methods to minimize soil compaction outside of building pads, pavement areas and utility trenches and shall use tracked equipment wherever practicable. Topsoil shall be salvaged and reused to the extent practicable. Phase Construction Activity Operator must not disturb more land than can be effectively inspected and maintained. Sediment control practices shall be established on all down gradient perimeters before any upgradient land disturbing activities begin. These practices shall remain in place until final stabilization has been established in accordance with the Permit. The timing of the installation of sediment control practices may be adjusted to accommodate short-term activities such as clearing or grubbing, or passage of vehicles. Any short-term activity must be completed as quickly as possible and the sediment control practices shall be installed immediately after the activity is completed. However, sediment control practices shall be installed before the next precipitation event even if the activity is not complete. Control Stormwater Flowing onto and Through the Project The normal wetted perimeter of any temporary or permanent drainage ditch or swale that drains water from any portion of the construction site, or diverts water around the site, shall be stabilized within 200 lineal feet from the property edge, or from the point of discharge into any surface water. Stabilization of the last 200 lineal feet shall be completed within 24 hours after connecting to a surface water. Stabilization of the remaining portions of any temporary or permanent ditches or swales shall be complete within 14 days after connecting to a surface water and construction in that portion of the ditch has temporarily or permanently ceased. Temporary or permanent ditches or swales that are being used as a sediment containment system (with properly designed rock ditch checks, bio rolls, silt dikes etc.) do not need to be stabilized. These areas shall be stabilized within 24 hours after no longer being used as a sediment containment system. Stabilize Soils All exposed soil areas, including stockpiles, must be stabilized. Stabilization must be started immediately to limit soil erosion when the construction activity in that portion of the site has temporarily or permanently ceased and will not resume for 14 calendar days. Stabilization must be complete within 14 days of cessation of construction activity. Temporary soil stockpiles shall have silt fence or other effective sediment controls, and cannot be placed in surface waters, including storm water conveyances such as curb and gutter systems, or conduits and ditches unless there is a bypass in place for the storm water. Temporary stockpiles without significant silt, clay or organic components (e.g. clean aggregate stockpiles, demolition concrete stockpiles, sand stockpiles) and the constructed base components of roads, parking lots and similar surfaces, are exempt from this requirement. Perimeter sediment control measures must be in place prior to the placement of any stockpiles. Any erosion control netting shall be "wildlife friendly" and of a natural type that can decompose and shall have non-welded moveable joints. Any sediment control device made of soil must be stabilized within 24 hours. Protect Slopes Operator shall avoid work on slopes with a grade of 3:1 or greater when practicable. Grading on slopes with a grade of 3:1 or steeper will require techniques such as phasing and stabilization practices designed for steep slopes(e.g. slope draining and terracing). Protect Storm Drain Inlets All storm drain inlets shall be protected by appropriate BMPs during construction until all sources with potential for discharging to the inlet have been stabilized. Inlet protection may be temporarily removed if a specific safety concern has been identified. Provide Energy Dissipation at all Pipe Outlets within 24 Hours After connection to a surface water or permanent stormwater treatment system. Establish Perimeter Controls and Sediment Barriers Prior to disturbing soils on a project site, establish sediment control BMPs on all down-gradient perimeters and where site discharges to public waters. Retain Sediment On-site and Control Dewatering Practices Discharge shall not cause nuisance conditions, erosion in receiving channels, adversely affect receiving water or impact wetlands, or downstream properties. Discharge points shall be adequately protected from erosion and scour by accepted energy dissipation measures. Discharge water containing oil or grease shall be treated to remove oil or grease prior to discharge to surface waters. Refer to Permit requirements for temporary or permanent sediment basins. Discharge shall be photographed at the beginning of discharge and at least every 24 hours afterward, while discharge is occurring. If nuisance conditions result from dewatering, dewatering shall be stopped until nuisance condition can be remedied. Establish Stabilized Construction Exits Vehicle tracking pads shall be established as shown on the Grading, Drainage, Paving and Erosion Control sheet(s) to minimize tracking of sediment from the construction site onto adjacent streets. Dewatering and Basin Draining Permittees must discharge turbid or sediment-laden waters related to dewatering or basin draining to a temporary or permanent sediment basin. Discharges must not cause erosion or scour near the discharge points. Remove Sediment from Surface Waters All sediment deposits and deltas must be removed from surface waters, including drainage ways, catch basins, and other drainage systems, and the removal areas restabilized within seven (7) days. 1. 2. 3. 4. 5. 6. 7. 8. 9. 10. 11. 12. 13. Permittees must ensure that a trained person will inspect the entire construction site at least once every seven (7) days during active construction and within 24 hours after a rainfall event greater than 0.5-inches in 24 hours. Records of inspections shall include all maintenance activities and must be recorded within 24 hours of the inspection and retained with the SWPPP. Inspections shall include stabilized areas, erosion prevention and sediment control BMPs. Additionally, areas adjacent to the project shall be inspected. Surface waters on or adjacent to the site must be inspected for evidence of erosion or sediment deposition. Permittees must record all inspection and maintenance activities within 24 hours of being conducted as detailed in the Permit. Inspection Records content shall include: A.Date and time of inspections; B.Name of persons conduction inspections; C.Findings of inspections, including specific locations where corrective actions are needed; D.Corrective actions taken including dates, times, and the party taking the corrective action; E.Dates of all rainfall events greater than 1/2 inch in 24 hours (refer to Permit for measurement requirements); F.Any discovered discharge must be recorded, including photographs, descriptions of discharge (color, odor, settled or suspended solids, oil sheen, or other obvious indicators of pollution), and specific location of discharge location; G.Any amendments to the Permit as a result of inspections must be documented within seven calendar days as described in the Permit H.All photographs of dewatering activities and documentation of nuisance conditions resulting from dewatering. BMP Maintenance: A.Nonfunctional BMPs must be repaired or replaced by the end of the next business day after discovery unless a different time frame is indicated. B.Follow the designer's or manufacturer's recommended maintenance procedures for all BMPs. C.Remove sediment from BMPs when the depth of sediment has reached 1/2 the height of the BMP and properly dispose of sediment into controlled areas to prevent soil from returning to the BMP during subsequent rain events. D.Remove sediment from paved roadways within one calendar day of discovery. E.Remove sediment from around BMPs protecting storm drain inlets. F.Surface waters with evidence of sediment deposition must be stabilized and sediment removed within seven calendar days of discovery, or as stated by the Permit. G.Ensure that construction support activities, including borrow areas, waste areas, contractor work areas, and material storage areas and dedicated concrete and asphalt batch plants are cleaned and maintained. H.Replace damaged BMPs that no longer operate effectively. Add BMPs as needed during construction to minimize erosion and prevent sediment from leaving the site. RECORD KEEPING / RECORD RETENTION The SWPPP (original or copies), including all changes to it, and inspections and maintenance records, shall be kept at the site during construction by the Owner / Operator who has operational control of that portion of the site. The SWPPP can be kept in either the field office or in an on site vehicle during normal working hours. All Owners(s) must keep the SWPPP, along with the following additional records, on file for three (3) years after submittal of the Notice of Termination (NOT). This does not include any records after submittal of the NOT. The following is a list of records that shall be kept at the project site available for inspectors to review: Copy of the SWPPP, with any modifications; Inspection and maintenance records; Permanent operation and maintenance agreements; Calculations for the design of temporary and permanent stormwater management systems; Any other permits required for the project; Records of all inspection and maintenance conducted during construction; and All permanent operation and maintenance agreements that have been implemented, including all right-of-way, contracts, covenants and other binding requirements regarding perpetual maintenance 1. 2. 3. Stabilize outlets from temporary / permanent sedimentation basins within 24-hours of outlet construction. Perform work in phases to minimize disturbed area at any one time. The construction of structures within the PUD District shall conform to minimum requirements set forth by Chapter 17 of the Zoning Ordinance for the base zoning districts established by Section 3 of this Ordinance, except as may be modified by approval of a PUD Development Stage Plan. Section 6. Amendments. Modification of the allowed uses, performance standards, and lot requirements established by this PUD District or the inclusion of additional lands within this PUD District shall be processed in accordance with Chapter 3 of the Zoning Ordinance. 2 Section 7. Zoning Map. The Zoning Map of the City of Otsego shall not be republished to show the aforesaid rezoning, but the Zoning Administrator shall appropriately mark the Zoning Map on file at City Hall for the purpose of indicating the rezoning hereinabove provided for in this Ordinance, and all of the notations, references and other information shown thereon are hereby incorporated by reference and made part of this Ordinance.
