No Yes, held by Planning Commission 18 May 2026 BACKGROUND/JUSTIFICATION: Endeavor Investments XII developed the Jacobs Plat as a one lot and one outlot subdivision and constructed a 401,544 square foot industrial warehouse and distribution facility (with potential future expansion) at 6400 Queens Avenue. The City Council approved the site and building plans on 28 March 2022 and the final plat was approved on 9 May 2022. The current tenant of the building intends to vacate and a new tenant that distributes specialty building materials would assume occupancy. The prospective new tenant requires an area for outdoor storage of building materials as part of their operations. The proposed outdoor storage area requires consideration of an Interim Use Permit, as well as a preliminary plat and vacation of existing drainage and utility easements to increase the area of Lot 1, Block 1, Jacobs Plat to accommodate the outdoor storage area. The preliminary plat and Interim Use Permit applications are subject to review by the Planning Commission and approval of the City Council. A public hearing to consider the applications was held by the Planning Commission on 18 May 2026. Draft minutes of the portion of the Planning Commission meeting for the public hearing concerning the application incorporating public comments and questions, as well as the discussion by the Planning Commission, are attached for information. The Planning Commission closed the public hearing. Following further discussion, the Planning Commission voted 6-0 to recommend approval. City staff has also updated the Planning Report following the Planning Commission meeting, which is attached. City staff has drafted a resolution approving the preliminary plat and Interim Use Permit subject to the conditions as recommended by the Planning Commission. The developer is asking that in reviewing the application, City Council members specifically address the proposed conditions of approval for screening and hours of operation. The developer will be prepared to present more detail regarding their proposed screening based on the Planning Commission discussion. It is also requested by the developed that the subject property be allowed 24-hour operations as currently exists. The subject property is guided by the Comprehensive Plan for light industrial land uses. This land use category includes office, warehouse, and distribution facilities as a primary use for the area to encourage location of businesses with larger, high quality buildings and employment opportunities. Although no physical changes to the building are proposed at this time, the change in occupancy will result in creation of more than 100 jobs on site. The existing and proposed use of the property is consistent with the goals and policies of the Comprehensive Plan. Zoning. The subject property is zoned I-1, Limited Industrial District, which is intended to provide for the establishment of light industrial activities, characterized by low impact manufacturing and warehousing uses and limit activities that may cause nuisance and pollution characteristics. Building material distribution facilities are a permitted use of the I-1 District. The change in occupancy also involves a proposed outdoor storage area for building materials, which is allowed in the I-1 District subject to approval of an Interim Use Permit. Surrounding Area. Additional development of this type is planned to the north. The primary compatibility concern with any industrial use of the subject is with the residential neighborhoods to the south, which must be addressed through site design, landscaping, and screening. EAW. An Environmental Assessment Worksheet was prepared in accordance with Minnesota Rules 4410.4300, Subp. 14 to evaluate the potential environmental effects of the initial site development. The EAW document was noticed on 8 January 2022. On 11 January 2022, the EAW document was published by the Environmental Quality Board (EQB) and distributed to stakeholders and agencies identified by the EQB. Comments were received from the Minnesota Pollution Control Agency (MPCA), Minnesota Department of Natural Resources (DNR), and State Historic Preservation Office (SHPO) during the 30-day comment period. On 14 March 2022, the City Council adopted Findings of Fact, Conclusions, and Response to Comments and determined that the development did not have potential for significant environmental effects and that preparation of an Environmental Impact Statement is not to be required. 3 Lot Area. Section 11-85-7.A of the Zoning Ordinance requires lots within the I-1 District to have a minimum area of 1.0 acre. Existing Lot 1, Block 1 is 20.74 acres in area. The proposed preliminary plat shifts the property line between existing Lot 1, Block 1 and Outlot A east approximately 600 feet to accommodate a potential future 200,185 square foot building addition and current proposal for a 10.04 acre outdoor storage area. The proposed 38.65 acre area of Lot 1, Block 1 exceeds the minimum area required for lots within the I-1 District. Lot Width. Section 11-85-7.B of the Zoning Ordinance requires lots within the I-1 District to have a minimum width of 200-feet at the front setback line. The existing lot measures 642-feet at the setback line from 65th Street, which is the front lot line as defined by the Zoning Ordinance. The width of the lot is increased by 597 feet as a result of the preliminary plat and complies with the requirements of the Zoning Ordinance. Site Coverage. Section 11-85-8 of the Zoning Ordinance establishes a maximum building coverage limit of 50-percent and maximum impervious surface coverage limit of 85-percent for lots within the I-1 District. Building coverage for the existing building and future addition 37 percent of the lot area, which complies with the requirements of the Zoning Ordinance as shown on Sheet C1. Impervious surface as are shown on Sheet C1 to cover 28.21 acres or 73 percent of the lot, which is within the limit established by the Zoning Ordinance. Right-of-Way. The subject property abuts Queens Avenue on the east and 65th Street to the north. Queens Avenue is an improved Industrial/Commercial Major Collector Street in accordance with the Transportation Plan of the 2023 Comprehensive Plan. The Transportation Plan designates 65th Street as an Industrial/Commercial Major Collector Street. The Jacobs Plat provided for dedication of all right-of-way necessary for Queens Avenue and 65th Street and no additional right-of-way is required with the proposed preliminary plat. Access. The subject property is accessed via two driveways to Queens Avenue aligned with driveways on the west side of the street to minimize conflicts from turning vehicles. The south access is 110-feet north of 62nd Street, which is a local residential street. The north access is 110-feet south of the 65th Street, which is a future Industrial/Commercial Collector Street. The location of the driveways complies with Section 11-21-6 of the Zoning Ordinance. No changes to the existing access to the property, including no new access to 65th Street, is proposed with the current application. 65th Street. On the north line of the subject property, 65th Street exists as a rural section gravel roadway. The Subdivision Ordinance requires that when a property is subdivided, abutting roadways must be improved to the standard designated by the Transportation Plan. The City deferred improvement of 65th Street with the Jacobs Plat as a means of financial assistance for the development. The Jacobs Plat approval includes a condition that upon platting any portion of existing Outlot A, the developer is responsible for improvement of 65th Street to an industrial street standard if the roadway is not already improved. 4 The developer has submitted plans for improvement of 65th Street as an urban industrial street along the north line of proposed Lot 1, Block 1. The roadway is to be a 46 foot wide asphalt section with concrete curb and gutter within the existing right-of-way and roadway easement. The Developer has requested that the City construct the street (along with sewer, water, and storm utilities) as a public project and assess the costs to Lot 1, Block 1. There would be no assessments to other abutting properties. How 65th Street will be constructed and the timing for the improvement requires further discussion between the developer and City prior to approval of a final plat and execution of a development contract. Outdoor Storage. The developer is proposing outdoor storage areas to the south and west of the existing principal building. Accessory outdoor storage is allowed within the I-1 District as an interim use subject to the following standards:  Section 11-85-3.D.1 of the Zoning Ordinance limits the area of the subject property allowed to be used for outdoor storage to 30 percent of the lot area. Sheet C1 identifies that Lot 1, Block 1 is proposed to be 38.65 acres and that the area of outdoor storage is to be 10.04 acres. The outdoor storage area as proposed is 26 percent of the lot area and complies with the limit established by the Zoning Ordinance.  Accessory outdoor storage within the I-1 District is subject to the same setback requirements as the principal building established by Section 11-85-7.C of the Zoning Ordinance. As shown in the table below, the outdoor storage area complies with applicable setbacks. ROW Side Rear Required 30ft. 10ft. 20ft. Proposed 55ft. 20ft. NA The developer has submitted site cross section drawings to illustrate the physical distance between the outdoor storage area and residential neighborhoods to the south. The closest dwelling to the south is just over 350 feet from the proposed outdoor storage area. The separation between the residential dwellings and proposed outdoor storage area is a factor mitigating potential compatibility issues between the two uses.  Section 11-85-3.D.2 and 3 of the Zoning Ordinance requires the outdoor storage area to be landscape, fenced, and screened from view of neighboring residential district and public rights-of-way. “Screening” may also serve to mitigate potential noise impacts related to the interim use as discussed by the Planning Commission. The standards for required screening are established by Section 11-19-3 of the Zoning Ordinance requiring effective screening a minimum of eight feet in height with the specific requirements based on distance, topography, and characteristics of the outdoor storage. 5 As noted above, the outdoor storage area is setback 55 feet from 65th Street and more than 350 feet from the closest residential dwelling to the south of the subject property. The elevation of the outdoor storage area is approximately the same as 65th Street and approximately 10 feet lower than the ground elevations of the residential homes to the south. The applicant narrative states that the outdoor storage is to be used for building materials stacked to a height of 12 feet. Sheet C3 identifies a chain link security and screening fence at the perimeter of the outdoor storage area. There is also an existing six foot privacy fence along the south property line between Queens Avenue and delineated wetlands. The site line screening exhibit illustrates installation of two additional sections of six foot fencing constructed on berms and plantings of deciduous and coniferous streets between the outdoor storage area and closer to the residential neighborhoods to provide more effective screening. Along 65th Street, landscaping, berm and fencing is to be installed as well between in the yard between the public right-of-way and outdoor storage area. The developer has submitted a landscape plan and details for the proposed fencing, which is to be constructed of Trex brand composite materials. The developer offers that the combination of berms, plantings, and berms, together with the distance and changes in elevation between the outdoor storage area and surrounding residential dwellings is sufficient to maintain compatibility. Questions and comments from the public focused on the screening of the outdoor storage area from the existing homes both from the north and south of the subject property and the Planning Commission discussed this issue at length. The consensus of the Planning Commission was that the proposed screening needed to be enhanced to be more effective by: o Increasing the height of the screening in the yard along 65th Street to a minimum of 14 feet, measured at the back of curb of 65th Street, with a combination of berms, plantings, and fence. o Installing an additional 14 foot high fence the full width of the south line of the outdoor storage area. These changes are recommended by the Planning Commission to be shown on revised site, grading and landscape plans. The revised landscape plan is also to include more dense species of deciduous trees to provide more effective screening during leaf-on seasons. City staff noted that coniferous trees to be planted are required to be a minimum of six feet in height measured to the leader. Plans for the proposed fence sections and landscaping are to be subject to review and approval of the Zoning Administrator. 6  Section 11-85-4.D.4 of the Zoning Ordinance requires that the outdoor storage area be surfaced with asphalt or concrete. Sheet C3 indicates that the proposed outdoor storage area is to have an asphalt surface surrounded by concrete curb and gutter, which complies with the Zoning Ordinance. The specifications for the outdoor storage area surface and curb are to be subject to review and approval of the City Engineer.  Noise emanating from the outdoor storage area is subject to regulation in accordance with Section 11-16-XX of the Zoning Ordinance, which adopts Minnesota Pollution Control Agency standards. Concerns were raised during the public hearing about noise from semi-tractor/trailers, on-site equipment, and the moving of materials within the subject property, and specifically the outdoor storage area. The City does not typically address licensed vehicle noise. As to the concern about reverse alarms, the Occupational Safety and Health Administration standards require: No employer shall use any motor vehicle equipment having an obstructed view to the rear unless: (i) The vehicle has a reverse signal alarm audible above the surrounding noise level or: (ii) The vehicle is backed up only when an observer signals that it is safe to do so. The reverse alarms are likely not of sufficient sound level or duration to violate limits on outdoor noise. Single-tone alarms, however, can be auditable and considered to be a nuisance by those in the surrounding area. The Occupational Safety and Health Administration allows for use of alternatives to single-tone reverse alarms provided that the sound is audible above the surrounding noise level. The Planning Commission recommended a condition of approval requiring use of such alternative reverse alarms only for on-site equipment as enforcement related to semi-tractor/trailers would likely be impractical.  Section 11-85-3.D.7 of the Zoning Ordinance provides that an Interim Use Permit terminates upon terminate upon a change of occupancy or the other events stated in Section 11-5-4 of the Zoning Ordinance: o The date or event stated in the interim use permit. o Upon violation of conditions under which the interim use permit was issued. o Upon change in the City's zoning regulations that renders the use nonconforming. 7 o The redevelopment of the use and property upon which it is located to a permitted or conditional use as allowed within the respective zoning district. The termination of an Interim Use Permit allows the City to determine if the circumstances surrounding the outdoor storage have changed in the event the use of the property changes, such as the prospective tenant is replaced with another tenant desiring outdoor storage but that which has a height greater than 12 feet. As such, no specific date for termination of the permit is to be conditioned. City staff notes that, as a property owned by investors, a change in ownership does not terminate an Interim Use Permit as this may have no impact to the use of the subject property. Hours of Operation. The existing use of the subject property as a permitted use is not limited in terms of hours of operation. For the outdoor storage, as an interim use, the City may impose any condition it considers necessary to mitigate potential negative impacts. City staff recommended, and the Planning Commission concurred, that a limit on hours of operation within the outdoor storage is appropriate as a condition of approval to minimize potential noise that could impact surrounding residential properties. The recommended hours are no operations within the outdoor storage area to be allowed between the hours of 10:00PM and 7:00AM each day. These hours correspond to the period of nighttime noise limits established by Minnesota Pollution Control Agency Rules. Exterior Lighting. Section 11-16-6 of the Zoning Ordinance establishes performance standards for exterior lighting. All exterior light fixtures are to have a 90-degree horizontal cut-off and not cast more than 0.4 foot-candles of light at the property lines as required by Section 11-16-6.C of the Zoning Ordinance. An exterior lighting plan including photometric measurements of light intensity and indicating the type, location, and height of all exterior light fixtures was submitted with application for building permit of the existing building and complies with the Zoning Ordinance. City staff has also field verified the intensity of light on the property measured at the south property line as complying with the Zoning Ordinance. Installation of additional exterior lighting will require submission of an updated photometric lighting plan, which is subject to review and approval of the Zoning Administrator. Waste Storage. The submitted plans do not indicate an existing or proposed exterior storage area for trash and recycling containers. Section 11-18-4.C of the Zoning Ordinance requires that any outdoor storage of waste and recycling containers is to be enclosed within a solid wall with minimum height of six feet constructed of materials complementary of the principal building. If waste containers are to be stored outdoors, plans for the construction of the required enclosure must be submitted to verify compliance the performance standards of the Zoning Ordinance. Any exterior enclosure for waste storage is subject to review and approval of the Zoning Administrator. 8 Signs. Section 11-37-5.C of the Zoning Ordinance allows one freestanding sign with an area not to exceed 100-square feet or height of 20-feet and wall signs not exceeding 100-square feet up to 15-percent of the area of the walls facing public streets. Existing signage on the subject property was approved with issuance of a sign permit. The submitted plans do not detail any new or additional signage. Installation of any new or additional signs upon the subject property will require issuance of a sign permit subject to review and approval of the Zoning Administrator in accordance with Section 11-37-7.A of the Zoning Ordinance. Utilities. The subject property is served by a temporary lift station for collection of sewer to Queens Avenue and water utilities. Gravity sewer is to be extended to the subject property from the east in the future, but the timing is unknown. Construction of 65th Street will require coordination with the City Engineer installation of utilities for future service needs. All utility plans are subject to review and approval of the City Engineer. With expansion of Lot 1, Block 1 as shown on the preliminary plat, the developer is be required to pay Utility Availability Charges for 17.91 acres of existing Outlot A being final platted as a buildable lot. Grading. The developer has submitted plans for grading of the subject site, including information required regarding stormwater management and erosion control. All grading, drainage, and erosion control issues are subject to review and approval by the City Engineer. Easements. Drainage and utility easements were dedicated over areas of Lot 1, Block 1 and Outlot A with the Jacobs Plat as required by Section 11-8-12.A of the Subdivision Ordinance. These easements are to be vacated with the replatting of the subject property to ensure an orderly property record. The preliminary plat provides for 10 foot wide drainage and utility easements to be dedicated at the perimeter of Lot 1, Block 1 and drainage and utility easements over water utilities, stormwater basins, wetlands and wetland buffers within both Lot 1, Block 1 and Outlot A. All drainage and utility easements are to be subject to review and approval of the City Engineer. Park Dedication. The proposed preliminary plat expanding the area of Lot 1, Block 1 triggers park dedication requirements as provided for in Section 10-8-15 of the Subdivision Ordinance. The Parks System Master Plan does not identify acquisition of land from the subject site for park purposes. Park dedication for the proposed plat is to require payment of a cash fee in lieu of land for the 19.71 acres of Outlot A being final platted. RECOMMENDATION The proposed preliminary plat to expand Lot 1, Block 1, Jacobs Plat and request for an Interim Use Permit to allow accessory outdoor storage upon the subject property complies with the provisions of the Subdivision Ordinance and Zoning Ordinance. City staff recommends approval 9 of the applications subject to conditions as listed below as stated in the resolution presented to City Council for consideration. POSSIBLE ACTIONS A. Motion to recommend City Council approval of a preliminary plat for Jacobs Plat Second Addition and an Interim Use Permit for Lot 1, Block 1, Jacobs Plat Second Addition, subject to the following conditions: 1. The subject property shall be developed in accordance with the site and building plans submitted to the City subject to the stipulations, limitations, and conditions as approved by the City Council in accordance with Section 11-9-4 of the Zoning Ordinance. 2. The Interim Use Permit allowing accessory outdoor storage shall terminate upon the happening of any of the following events, whichever occurs first: a. Upon violation of conditions under which the interim use permit was issued. b. Upon change in the City's zoning regulations that renders the use nonconforming. c. The redevelopment of the use and property upon which it is located to a permitted or conditional use as allowed within the respective zoning district. d. Upon the building materials tenant for which the outdoor storage is an accessory use vacating the property. e. Upon a change in type, height, or other characteristics of the outdoor storage of building materials, as determined by the City Council. 3. Final platting of any portion of Outlot A, Jacobs Plat or Outlot A, Jacobs Plat Second Additon as a lot/block or as an expansion of an existing lot shall require that 65th Street be constructed as an Industrial/Commercial Major Collector Street in compliance with Section 10-8-5.A.7 of the Subdivision Ordinance, unless the roadway has already been improved to that standard. 4. Screening: a. The landscape, including type of plantings, quantities, and sizes shall comply the requirements of Section 11-19-3 of the Zoning Ordinance, subject to review and approval of the Zoning Administrator. 10 b. The minimum height for coniferous trees to be planted for screening purposes shall be six feet measured to the base of the leader. c. The following additional screening shall be required, subject to review and approval of the Zoning Administrator: (1) The yard between 65th Street and the outdoor storage area shall be screened to a minimum height of 14 feet, measured at the back of curb of 65th Street, with a combination of berms, plantings, and fences. (2) A fence shall be constructed to a minimum height of 14 feet along the south line the full width of the outdoor storage area. d. A fence permit shall be required prior to installation of any fences within the subject property, subject to review and approval of the City Engineer. 5. The specifications for the outdoor storage area surface and curb are to be subject to review and approval of the City Engineer. 6. Movement of building materials into, out of, or with the outdoor storage area shall be prohibited between the hours of 10:00PM and 7:00AM each day. 7. On-site equipment (e.g, forklifts) shall be equipped only with a reverse signal alarm that utilizes an alternative to a single-tone type that complies with Occupational Safety and Health Administration regulations. 8. All exterior lighting shall comply with Section 11-16-6 of the Zoning Ordinance, subject to review and approval of the Zoning Administrator. 9. Waste or recycling shall be stored within the principal building or any outdoor storage of such containers shall comply with the provisions of Section 11-18-4.C of the Zoning Ordinance, subject to review and approval of the Zoning Administrator. 10. All signs upon the property shall comply with Chapter 37 of the Zoning Ordinance and require issuance of a sign permit prior to installation, subject to review and approval of the Zoning Administrator. 11. All utility plans are subject to review and approval of the City Engineer. 11 12. The developer shall pay Utility Availability Charges for the proposed lot at the time of final plat approval based upon the net increase in the area of Lot 1, Block 1 Jacobs Plat. 13. All grading, drainage, and erosion control plans and issues shall be subject to review and approval by the City Engineer. 14. The developer shall pay Utility Availability Charges for the proposed lot at the time of final plat approval based upon the net increase in the area of Lot 1, Block 1, Jacobs Plat. B. These requests are being made to accommodate the operational needs of a prospective new tenant for the site. The current tenant has notified the Applicant of its plans to vacate the Property as part of an effort to right-size its business operations. In response, the Applicant has identified a new user for the facility that will provide significant economic and community benefits to the City of Otsego. These benefits include the creation of more than 100 permanent jobs, continued productive use of the Property, and preservation and enhancement of the City’s tax base by preventing long-term vacancy. The prospective tenant is a leading distributor of specialty building materials serving customers throughout the Upper Midwest. The tenant proposes retrofitting the existing approximately 400,000-square-foot facility and constructing a secure outdoor storage area to support its operations. The outdoor storage area will be used for the orderly storage and distribution of building materials, with materials stacked up to 12 feet in height. The storage area will be appropriately screened from adjacent properties in accordance with City standards. A line of site plan illustrating the proposed screening is included as Exhibit A. Also Present: Councilmember Dunlap and Mayor Stockamp Staff: City Planner Daniel Licht and Deputy Clerk Katie Kalland 1. Announcements City Planner Licht noted additional handouts located on the dais for the commission related to Item 3.1. 2. Consider the Following Minutes 2.1 April 6, 2026, Planning Commission Meeting Commissioner Kincanon motioned to approve April 6, 2026, minutes as written. Seconded by Commissioner Metzger. All in favor. Motion carried 6-0. 3. Public Hearing Items 3.1 Endeavor Investments XII LLC; Vacation of drainage and utility easements, Preliminary and Final Plat, Interim Use Permit City Planner Licht gave the planning report. Evan Mattson, applicant, Endeavor Investments XII was present and agreed with the planning report with additional comments. Mr. Mattson proposed installing a taller berm in lieu of a 7- foot fence as recommended by City staff or some combination increased berm, plantings and a fence for a more natural look. Mr. Mattson also stated that the operation is requesting operations on the property 24 hours a day. Chair Offerman opened the public hearing at 7:20 p.m. Noah Barka, 16580 62nd ST NE, spoke against the proposed expansion of the building noting concern with the outdoor storage use reading the comments he had provided prior to the meeting with additional notes. Nathan Anderson, 16780 65th ST NE, spoke against the proposed expansion of the building. Mr. Anderson expressed concern about the noise and the conditions of 65th Street due to semi- tractor/trailer traffic. MINUTES OF OTSEGO PLANNING COMMISSION May 18, 2026 Page 2 of 5 Brian Hoffman, 16742 62nd ST NE, expressed concern about the potential noise level of outdoor equipment. Brandon Halberstadt, 16814 62nd ST NE, expressed concern regarding local wildlife and inquired whether an environmental assessment had been conducted. Chair Offerman closed the public hearing at 7:30 p.m. City Planner Licht stated that when the property was initially reviewed for development an environmental assessment took place and found no potential concerns. Mr. Mattson acknowledged that a 6-foot fence would not be sufficient, which is why a combination of a berm and fence is proposed. Mr. Mattson further explained that the business will operate as a warehouse/office facility rather than as a trucking company in comparision to R+L Carriers nearby. Mr. Mattson noted outdoor storage would consist of residential building materials stacked up to 12- feet high. Commissioner Jones asked if any manufacturing would occur inside the building. Mr. Mattson stated that no manufacturing would take place. Commissioner Jones asked whether the backup noise from equipment used outdoors could be regulated. City Planner Licht stated that a condition could be added regarding equipment kept onsite to require alternative reverse alarms as allowed by OSHA. Chair Offerman asked about screening requirements for other industrial developments in the City and how those developments were addressed. City Planner Licht noted that when R+L Carriers and Kwik Trip each developed, a 14-foot fence was installed. Commissioner Kincanon asked if trees will be removed from the property. City Planner Licht answered no as the property was initially graded with building expansion in mind. Mr. Mattson stated they will be planting approximately 100 additional trees on the property. Commissioner Jones asked about the operating shifts for the building. Mr. Mattson stated that the building will operate with two shifts and that the site will require 24-hour access to the outdoor storage area. Chair Offerman would like to see taller fencing or a berm, as well as the substitution of hardier tree species in place of the proposed landscaping. Discussion followed between the Planning Commission, City staff, and Mr. Mattson regarding the proposed berm, landscaping options, and site elevations along 65th Street and south of the outdoor storage area. MINUTES OF OTSEGO PLANNING COMMISSION May 18, 2026 Page 3 of 5 Commissioner Jones proposed amending the conditons of approval to require enhancement of screening through combination of the berm, landscaping, and fences along the north and south sides of the outdoor storage area. Commissioner Stritesky motioned to recommend approval of a preliminary plat for Jacobs Plat Second Addition and an Interim Use Permit for Lot 1, Block 1, Jacobs Plat Second Addition, subject to the conditions listed on the May 15 planning report amended as follows: 4.c. The following additional screening shall be required, subject to review and approval of the Zoning Administrator: (1) The yard between 65th Street and the outdoor storage area shall be screened to a minimum height of 14 feet, measured at the back of curb of 65th Street, with a combination of berms, plantings, and fences. (2) A fence shall be constructed to a minimum height of 14 feet along the south line the full width of the outdoor storage area. 14. All on-site equipment (e.g, forklifts) shall be equipped only with a reverse signal alarm that utilizes an alternative to a single-tone type that complies with Occupational Safety and Health Administration regulations. Seconded by Foster. All in favor. Motion carried 6-0. 3.2 The Towers LLC; Conditional Use Permit City Planner Licht gave the planning report. Ryan Streff, applicant, The Towers LLC, was present and agreed with the planning report. Chair Offerman opened the public hearing at 8:25 p.m. Stewart Turnquist, 11020 95th ST NE, expressed concern regarding the potential impact on trumpeter swans and their flight paths. Chair Offerman closed the public hearing at 7:29 p.m. Commissioner Metzger asked whether a roundabout is proposed at the County Road 19/38 intersection. City Planner Licht stated that one is proposed for construction in 2029. City Planner Licht stated that the City is obligated to approve antennas that are demonstrated address the service coverage deficiencies. City Planner Licht said that in response to the 1 CITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA RESOLUTION NO: 2026-42 APPROVING PRELIMINARY PLAT FOR JACOBS PLAT SECOND ADDITION AND ADOPTING FINDINGS OF FACT AND APPROVING AN INTERIM USE PERMIT FOR LOT 1 BLOCK 1 JACOBS PLAT SECOND ADDITION WHEREAS, Endeavor Investments XII, LLC (“Developer”) has submitted application for a Preliminary Plat for a subdivision to be known as Jacobs Plat Second Addition; and WHEREAS, the Developer has submitted an application for an Interim Use Permit to allow accessory outdoor storage upon Lot 1, Block 1, Jacobs Plat Second Addition; and WHEREAS, the legal description of the Property (“Property”) is attached as Exhibit A; and WHEREAS, the Property is within the East Sewer District and guided for future Industrial land uses by the 2023 Comprehensive Plan; and WHEREAS, the Property is zoned I-1, Limited Industrial District; accessory outdoor storage is allowed as an interim use within the I-1 District; and WHEREAS, applications for preliminary plat approval are processed in accordance with the provisions of Section 10-5-2 of the Subdivision Ordinance; and WHEREAS, applications for an Interim Use Permit are processed in accordance with the provisions of Section 10-5-2 of the Zoning Ordinance; and WHEREAS, the City Council must take into consideration the possible effects of the proposed interim use with their judgment based upon (but not limited to) the criteria outlined in Section 11-5-2.F the Zoning Ordinance: 1. The proposed action's consistency with the specific policies and provisions of the Otsego Comprehensive Plan. Finding: The subject property is guided by the Comprehensive Plan for light industrial land uses. This land use is planned to encourage location of businesses with larger, high quality buildings and employment opportunities. The proposed change in occupancy, to which the requested outdoor storage is an accessory use, will result in creation of more than 100 jobs. The existing and proposed use of the property is consistent with the goals and policies of the Comprehensive Plan. 2. The proposed use's compatibility with present and future land uses of the area. Finding: The existing and proposed use of the subject property is characteristic of the industrial uses developed to the west within the Gateway North Industrial Park. Additional development of this type is planned to the north. The primary compatibility concern with any industrial use of the subject is with the residential neighborhoods to the south, which is addressed through site design, landscaping, and screening. 2 3. The proposed use's conformity with all performance standards contained within the Zoning Ordinance and other provisions of the City Code. Finding: The proposed preliminary plat and accessory outdoor storage use complies with the requirements of the Zoning Ordinance. 4. Traffic generation of the proposed use in relation to capabilities of streets serving the property. Finding: The subject property abuts Queens Avenue on the east and 65th Street to the north. Queens Avenue is an improved Industrial/Commercial Major Collector Street in accordance with the Transportation Plan of the 2023 Comprehensive Plan. The Transportation Plan designates 65th Street as an Industrial/Commercial Major Collector Street. The Jacobs Plat provided for dedication of all right-of-way necessary for Queens Avenue and 65th Street. The proposed preliminary plat includes improvement of 65th Street abutting Lot 1, Block 1 to an industrial street standard. The streets serving the subject property have adequate capacity to accommodate the traffic generated by the proposed use. 5. The proposed use can be accommodated by existing public services and facilities and will not overburden the City's service capacity. Finding: The subject property is located within the East Sewer District and is guided for industrial uses. The City anticipates delivery and has in place necessary infrastructure and services to support the proposed use of the subject property. WHEREAS, the Planning Reports dated 15 May 2026 and 19 May 2026 prepared by the City Planner, The Planning Company LLC, are incorporated herein. WHEREAS, the Planning Commission conducted a public hearing at their regular meeting on 18 May 2026 to consider the application, preceded by published and mailed notice; based upon review of the application and evidence received, the public hearing was closed and the Planning Commission recommended by a 6-0 vote that the City Council approve the request based on the aforementioned findings. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OTSEGO, MINNESOTA THAT the findings of fact outlined herein are adopted and the applications for preliminary plat of the Jacobs Plat Second Addition and an Interim Use Permit for Lot 1, Block 1, Jacobs Plat Second Addition are approved based upon the foregoing information and applicable ordinances, subject to the following conditions: 1. The subject property shall be developed in accordance with the site and building plans submitted to the City subject to the stipulations, limitations, and conditions as approved by the City Council in accordance with Section 11-9-4 of the Zoning Ordinance. 2. The Interim Use Permit allowing accessory outdoor storage shall terminate upon the happening of any of the following events, whichever occurs first: a. Upon violation of conditions under which the interim use permit was issued. b. Upon change in the City's zoning regulations that renders the use nonconforming. c. The redevelopment of the use and property upon which it is located to a permitted or conditional use as allowed within the respective zoning district. 3 d. Upon the specific tenant for which the building material outdoor storage is an accessory use vacating the property. e. Upon a change in type, height, or other characteristics of the outdoor storage of building materials, as determined by the City Council. 3. Final platting of any portion of Outlot A, Jacobs Plat or Outlot A, Jacobs Plat Second Additon as a lot/block or as an expansion of an existing lot shall require that 65th Street be constructed as an Industrial/Commercial Major Collector Street in compliance with Section 10-8-5.A.7 of the Subdivision Ordinance, unless the roadway has already been improved to that standard. 4. Screening: a. The landscape plan, including type of plantings, quantities, and sizes shall comply the requirements of Section 11-19-3 of the Zoning Ordinance, subject to review and approval of the Zoning Administrator. b. The minimum height for coniferous trees to be planted for screening purposes shall be six feet measured to the base of the leader. c. The following additional screening shall be required, subject to review and approval of the Zoning Administrator: (1) The yard between 65th Street and the outdoor storage area shall be screened to a minimum height of 14 feet, measured at the back of curb of 65th Street, with a combination of berms, plantings, and fences. (2) A fence shall be constructed to a minimum height of 14 feet along the south line the full width of the outdoor storage area. d. A fence permit shall be required prior to installation of any fences within the subject property, subject to review and approval of the City Engineer. 5. The specifications for the outdoor storage area surface and curb are to be subject to review and approval of the City Engineer. 6. Movement of building materials into, out of, or with the outdoor storage area shall be prohibited between the hours of 10:00PM and 7:00AM each day. 7. All on-site equipment (e.g, forklifts) shall be equipped only with a reverse signal alarm that utilizes an alternative to a single-tone type that complies with Occupational Safety and Health Administration regulations. 8. All exterior lighting shall comply with Section 11-16-6 of the Zoning Ordinance, subject to review and approval of the Zoning Administrator. 9. Waste or recycling shall be stored within the principal building or any outdoor storage of such containers shall comply with the provisions of Section 11-18-4.C of the Zoning Ordinance, subject to review and approval of the Zoning Administrator. 10. All signs upon the property shall comply with Chapter 37 of the Zoning Ordinance and require issuance of a sign permit prior to installation, subject to review and approval of the Zoning Administrator. 4 11. All utility plans are subject to review and approval of the City Engineer. 12. The developer shall pay Utility Availability Charges for the proposed lot at the time of final plat approval based upon the net increase in the area of Lot 1, Block 1 Jacobs Plat. 13. All grading, drainage, and erosion control plans and issues shall be subject to review and approval by the City Engineer. 14. The developer shall pay Park Fees in lieu of land for the proposed lot at the time of final plat approval based upon the net increase in the area of Lot 1, Block 1, Jacobs Plat. In response, the Applicant has identified a new user for the facility that will provide many benefits to the Otsego community. •The proposed project will investment significant capital into the property to ensure its continued productive. The tax base will be enhanced, and 100 jobs will be generated.
