Daniel Licht REPORT DATE: 14 May 2026 60-DAY DATE: 6 June 2026 RE: Otsego – 118-800-141407; Tower Conditional Use Permit TPC FILE: 101.02 BACKGROUND The Towers, LLC, has submitted plans to construct a new wireless communications tower and facilities within a leased area of the property at 10845 95th Street. The subject property is 44.91 acres in area at the southwest corner of 95th Street (CSAH 39) and Labeaux Avenue (CSAH 19). Standards have been adopted as part of the Zoning Ordinance to regulate wireless communications facilities to the extent allowed (and limited) by Federal law. The proposed new wireless communication tower requires consideration of a Conditional Use Permit, which is subject to review by the Planning Commission and approval of the City Council. A public hearing to consider the application has been noticed for the Planning Commission meeting on 18 May 2026 at 7:00PM. The 2023 Comprehensive Plan guides the subject property for rural uses. Telecommunications towers and antennas are regarded similarly to utilities for the purposes of zoning regulations and allowed as an incidental land use activity. These utilities provide services necessary for residents and businesses in the area, as well as transient users along regional roadway corridors like 95th Street (CSAH 39) and Labeaux Avenue (CSAH 19). The proposed telecommunications tower is consistent with the policies of the Comprehensive Plan. Zoning. The subject site is zoned A2, Long Range Urban Service District. telecommunications towers are allowed within the A1 District subject to the provisions of Chapter 33 of the Zoning Ordinance. Section 11-233-4.A.2 of the Zoning Ordinance requires issuance of a Conditional Use Permit for a free standing tower and antenna. Demonstrated Need. Section 11-33-4.A.2.a of the Zoning Ordinance requires that the applicant demonstrate that location of the telecommunications tower and antenna as proposed is necessary to meet the frequency reuse and spacing needs of the personal wireless service system and to provide adequate portable personal wireless service coverage and capacity to areas that cannot be adequately served by locating the antennas upon:  An existing tower or other structure; or  Within a less restrictive district. The applicant has provided analysis prepared by a Radio Frequency Engineer for Verizon Wireless, to define existing service capacities, identify potential locations for antenna installations, and evaluate the need for construction of a new tower. The analysis states that there is a significant service capacity gap in the area of the subject property that may result in diminished call quality, slow data speeds, and blocked or dropped calls. The lack of service impairs public safety by limiting access to E911 services. There are no other towers within the area of the subject property suitable to address the service capacity gap. The analysis showing the service capacity coverage with construction of a new tower and antenna upon the subject property resolves the existing gap and demonstrates the need for the proposed installation. Tower Performance Standards. Chapter 33 of the Zoning Ordinance outlines performance standards specific to construction of new telecommunications towers and antenna, which must be complied with for the City to approve the requested Conditional Use Permit:  Height. Section 11-33-2.C of the Zoning Ordinance requires that the height of the proposed telecommunications tower be the minimum necessary to address the identified service capacity gap. The maximum height of a telecommunications tower is 75 feet as allowed by Section 11-33-4.A.2.c(1) of the Zoning Ordinance. 3 The proposed tower is to be 75 feet in height, with an additional five feet in height for a lightning rod allowed by Section 11-17-3.B of the Zoning Ordinance. The height of the proposed telecommunications tower is illustrated on Sheet VZW A-1 of the construction plans. Paragraph 6 of the Radio Frequency Engineer analysis sufficiently details how the height of the proposed is the minimum necessary to correct the service capacity gap in combination with other towers in the City.  Signs. Section 11-33-2.E of the Zoning Ordinance allows only regulatory signs to be installed accessory to the proposed telecommunications tower and antenna. Proposed regulatory signage is illustrated on Sheet A-6 of the construction plans. The proposed signs and their location comply with provisions of the Zoning Ordinance and do not require issuance of a sign permit as provided for by Section 11-37-4.A.4 of the Zoning Ordinance.  Lighting. Section 11-33-2.G of the Zoning Ordinance prohibits the proposed telecommunications tower from being illuminated unless required by the Federal Aviation Administration. The applicant states that the proposed height of the telecommunications tower is below the Federal Aviation Administration threshold for required lighting. No lighting is proposed to be installed upon the telecommunications tower.  Color. Section 11-33-2.I of the Zoning Ordinance requires a telecommunications tower to be have a painted silver or galvanized finish to reduce visual impact. The proposed tower is a monopole design with galvanized finish. Photo illustrations of the proposed telecommunications tower have been submitted by the applicant to demonstrate potential visual impacts, or lack thereof due to physical distance from surrounding uses and existing mature tree canopies.  Co-Location. Section 11-33-2.J of the Zoning Ordinance requires that a telecommunications tower accommodate multiple antenna installations, including co- location of antennas from different service providers. The proposed telecommunications tower is designed to accommodate three wireless carries or other end users, such as the Wright County Sheriff, Otsego Fire Department, other City utilities, etc.  Setbacks. The setbacks required for structures within the A1 District are shown in the table below. The proposed telecommunications tower is located at the northeast corner of the subject site, with the closest property lines being the north and east abutting 95th Street (CSAH 39). Additionally, Section 11-33-4.A.2.c(1) of the Zoning Ordinance requires that the telecommunications tower be setback from the nearest residential structure a distance equal to the height of the tower. Sheets A-1 and A-1.1 of the construction plans illustrates that the telecommunications tower is setback a distance greater than its height from all property lines or residential dwellings within the subject 4 property. The telecommunications tower location complies with all applicable setback requirements. CSAH 39 CSAH 19 South West Required 65ft. 65ft. 10ft. 50ft. Proposed 130ft. 183ft. 210ft. 1,077ft. Equipment. The installation of the proposed telecommunications tower and antenna will include ground mounted transmitting, receiving, and switching equipment as shown on Sheets A-2, VZW A-1, VZW A-3, and VZW A-5 of the construction plans. This equipment will be enclosed within utility cabinets upon concrete pads at the base of the tower. Fence. The proposed telecommunications tower and ground mounted equipment will be enclosed within a six foot chain link perimeter security fence with barbed wire security arms above for a total height of seven feet detailed on Sheets A-4 and A-5 of the submitted construction plans. Gates are located on the north side of the perimeter fence enclosure to allow access to the telecommunications tower, antenna, and ground equipment. The proposed fence complies with the requirements of Section 11-19-4.H and Section 11-33-4.A.2.e of the Zoning Ordinance. A fence permit issued by the Zoning Administrator is required prior to construction of the proposed fence by Section 11-19-4.A of the Zoning Ordinance. Screening. The base of the telecommunications tower and ground equipment is required to be screened by Section 11-33-4.A.2.e of the Zoning Ordinance subject to the standards detailed in Section 11-19-3 of the Zoning Ordinance to a minimum height of eight feet. Sheet A-2.1 of the submitted construction plans provides a landscape plan for planting of 14 Black Hills spruce trees at the north, east, and south side of the perimeter fence to screen the base of the telecommunications tower from view of 95th Street (CSAH 19), Labeaux Avenue (CSAH 19), and properties to the south. To the west of the facility location are concrete barriers enclosing an area of the property used by the owner. The height of the proposed trees must be increased to eight feet measured to the base of the leader, but otherwise the proposed landscaping complies with the requirements of the Zoning Ordinance. Access. There is an existing access to the subject property from 95th Street (CSAH 39) to the northwest of the proposed tower location and setback approximately 400 feet from the intersection of 95th Street (CSAH 39) and Labeaux Avenue (CSAH 19). The driveway accessing the telecommunications tower location is proposed to be 12 feet wide and surfaced with gravel. The design and construction of the driveway is subject to review and approval of the City Engineer. City staff does not have concern regarding the use of the access given that traffic generated by the telecommunications facility is limited to occasional, infrequent maintenance. Use of the existing access for the purposes of reaching the telecommunications tower, antenna, and ground equipment is to be subject to review and approval of Wright County. Grading Plan. Sheets A-3 and A-3.1 of the construction plans provide a grading, drainage, and erosion control plan for the proposed telecommunications tower construction. The City 5 Engineer has reviewed the grading, drainage, and erosion control plans and determined they comply with the provisions of the Zoning Ordinance and Engineering Manual. Termination. Section 11-33-2.A of the Zoning Ordinance requires that all obsolete antenna must be removed from the subject property within 12 months from the date operation ceases. This requirement is recommended to be included as a condition of approval. Criteria. Section 11-4-2.F of the Zoning Ordinance establishes criteria by which the Planning Commission is to evaluate the application for a Conditional Use Permi. The recommendation of the Planning Commission is to be based upon, but not limited to, the following criteria: 1. The proposed action's consistency with the specific policies and provisions of the Otsego Comprehensive Plan. Comment: The proposed telecommunications tower and antenna is a facility necessary telecommunications ancillary to existing and future development, as well as regional travel, within the area necessary for communication services, including emergency response. The Zoning Ordinance establishes performance standards for telecommunications tower and antenna to minimize impacts to surrounding properties, including height limits and requirements for security and screening. With adherence to these performance standards, the proposed telecommunications tower and antenna will be consistent with the policies of the Comprehensive Plan. 2. The proposed use's compatibility with present and future land uses of the area. Comment: The subject property is surrounded by the existing and planned land uses shown in the table below. The most-dense residential development is the five acre lots along the west line of the subject property; areas to the north, east, and south are more sparkly populated with homes and the Northstar Regional facility is located well north of 95th Street CSAH 19. The area has many mature trees with height sufficient to screen views of the proposed telecommunications tower in all directions as shown on the submitted photo simulations. The proposed use's conformity with all performance standards contained within the Zoning Ordinance and other provisions of the City Code. 6 Comment: The proposed telecommunications tower and antenna comply with the provisions of the Zoning Ordinance. 4. Traffic generation of the proposed use in relation to capabilities of streets serving the property. Comment: The proposed telecommunications tower and antenna is accessed from 95th Street (CSAH 39). The use will not generate significant traffic except for occasional and infrequent maintenance, which is within the existing capacity of 95th Street (CSAH 39) 5. The proposed use can be accommodated by existing public services and facilities and will not overburden the City's service capacity. Comment: The proposed telecommunications tower and antenna will not impact City services, but will improve telecommunications service capacity, including for emergency services response, within the City. RECOMMENDATION The submitted plans for construction of a telecommunications tower and antenna complies with the requirements of the Zoning Ordinance. City staff recommends approval of the application as outlined below. POSSIBLE ACTIONS Motion to recommend City Council approval of a Conditional Use Permit for PID 118-800- 141407 to allow construction of a telecommunications tower and antenna, subject to the following conditions: 1. The subject property shall be developed in accordance with the site and building plans submitted to the City subject to the stipulations, limitations, and conditions as approved by the City Council in accordance with Section 11-9-4 of the Zoning Ordinance. 2. The tower shall not be illuminated unless required by the Federal Aviation Administration, subject to review by the Zoning Administrator. 3. Issuance of a fence permit shall be required prior to construction of the fence shown on the construction plans, subject to review and approval of the Zoning Administrator. 4. The height of the Black Hills Spruce to be planted with the landscape plan shall be a minimum of eight feet in height and shall be maintained as necessary to be alive and in good health at all times. 7 5. Use of the existing access to 95th Street for the purposes of reaching the tower, antenna, and ground equipment shall be subject to review and approval of Wright County. 6. The design and construction of the driveway shall be subject to review and approval of the City Engineer. 7. All grading, drainage, and erosion control issues shall be subject to review and approval of the City Engineer. 8. All obsolete antenna shall be removed from the subject property within 12 months from the date operation ceases. c. I have been employed by Verizon since 2018 and have been the RF Engineer for the Minneapolis/Northern Minnesota Market since 2022. 2. The primary duties of an RF engineer include the design and management of Verizon’s wireless communications network in its Great Plains Market, which includes the area in and around Wright County, Minnesota. RF Engineers are also responsible for identifying and addressing substantial service and capacity gaps that present themselves in Verizon’s wireless network. These service gaps can be caused by lack of coverage or insufficient system capacity, or both. Service gaps are identified through the use of internal Verizon network monitoring tools and analysis showing the capacity and/or coverage needs in a particular area. 3.There is a significant service capacity gap in Verizon’s wireless communications network in and around City of Otsego (the “Gap Area”). As a result of this significant service capacity gap, Verizon customers using their devices in and around the Gap Area are likely to experience diminished call quality, slow data transmission speeds, and blocked calls. Verizon’s service gap in the Gap Area has been amplified by the sharp increase in data usage by Verizon’s customers. 4. This significant service capacity gap will remain and cannot be resolved unless a communications tower is constructed within the Gap Area. Verizon must remedy this service capacity gap in order to provide high-speed wireless broadband access to the communities in and around the Gap Area, to fill in indoor coverage gaps where wireless services are not reliable, and to provide enhanced E911 services. 5. Verizon identified a search area in which a tower would need to be located in order to resolve the service gap. Before proposing a new communications tower, Verizon first considered whether any existing towers in the search area could be used to resolve the coverage gap in the Gap Area. There were no other structures in the search area on which Verizon could collocate to resolve the service gap in the Gap Area. 6. Verizon and Vertical Bridge have worked together to identify a property in the area that could accommodate a communications tower to correct the significant service capacity gap in Verizon’s wireless communications network. Vertical Bridge has proposed to build a new 75’ tower near HWY 39 and HWY 19, Otsego, MN 55362 (“Proposed Tower”). The tower height of 75’ is necessary because of the surrounding topography and the size of the area. This particular location is optimal because it will allow Verizon to cover substantially all of the area with a single tower. 2 7. By co-locating its communications equipment on the Proposed Tower, Verizon will resolve the current significant service capacity gap and will be able to provide improved service to residents, businesses, and emergency service providers in and around the Gap Area. If Vertical Bridge is unable to construct the new telecommunications tower, and Verizon is therefore unable to collocate its equipment on the proposed tower, the significant service capacity gap in Verizon’s wireless communications network will remain, and Verizon will be prohibited from providing reliable wireless service to its customers in the Gap Area.
