RES 2026-33 Adopting Findings of Fact and Approving Site and Building Plans for PID 118-802-021300CITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA RESOLUTION NO: 2026-33 ADOPTING FINDINGS OF FACT AND APPROVING SITE AND BUILDING PLANS FOR PID 118-802-021300. WHEREAS, FFI LLC ("Owner") has submitted application for a Zoning Map amendment and Site and Building Plan review for improvements to the property located at 5650 Queens Avenue; and WHEREAS, the legal description of the subject property ("Property") is attached as Exhibit A; and WHEREAS, the Property is within the East Sewer District and guided for future Industrial land uses by the 2023 Comprehensive Plan; and WHEREAS, the Property is zoned R-3, Residential Long Range Urban Service District; and WHEREAS, the Owner is requesting amendment of the Zoning Map to designate the property as 1-3 Special Industrial District; and WHEREAS, an application for Zoning Map amendments is processed in accordance with the provisions of Section 11-3-2 of the Zoning Ordinance; and WHEREAS, the City Council must take into consideration the possible effects of the Zoning Ordinance amendment with their judgment based upon (but not limited to) the criteria outlined in Section 11-3-2.F of the Zoning Ordinance, respectively: The proposed action's consistency with the specific policies and provisions of the Otsego Comprehensive Plan. Finding: The 2023 Comprehensive Plan guides the subject site for industrial uses within the East Sewer District. The industrial development guided for the subject site is to be smaller scale buildings and low intensity uses similar with the character of existing industrial uses in the area that were established prior to the area being annexed to the City in 1994. The industrial use of the subject property is consistent with the Future Land Use Plan and policies for development within this area of the City. The proposed use's compatibility with present and future land uses of the area. Finding: The subject property is surrounded by the existing and planned uses shown in the table below. The existing and proposed building create a visual barrier of the active portion of the property from view from the north. The residential uses to the north and southeast the subject property also have established tree lines that screen their view of the property, but plantings within the property need to be added to provide more screening of the industrial use from the surrounding residential properties. Finding: The proposed construction will be required to comply with the applicable performance standards of the Zoning Ordinance and Engineering Manual. 4. Traffic generation of the proposed use in relation to capabilities of streets serving the property. Finding: The subject site is accessed from Queens Avenue, which is designated by the 2023 Comprehensive Plan as a Commercial/Industrial Collector Street. The existing roadway has adequate capacity to accommodate traffic that will be generated by the expanded use of the subject property as proposed. 5. The proposed use can be accommodated by existing public services and facilities and will not overburden the City's service capacity. Finding: The proposed use is within the East Sewer District where urban uses are guided based on available infrastructure. The proposed expansion of the existing use does not require connection to City utilities. The development of the subject site will not impact City service capabilities. WHEREAS, the Owner is requesting approval of Site and Building Plan Review for a 12,900 square foot addition of the existing 6,674 square foot building upon the Property; and WHEREAS, an application for Site and Building Plan Review is processed in accordance with the provisions of Section 11-9-3 of the Zoning Ordinance; and WHEREAS, the Planning Report dated 2 April 2026 prepared by the City Planner, The Planning Company LLC, is incorporated herein. WHEREAS, the Planning Commission conducted a public hearing at their regular meeting on 6 April 2026 to consider the application, preceded by published and mailed notice; based upon review of the application and evidence received, the public hearing was closed and the Planning Commission recommended by a 6-0 vote that the City Council approve the request based on the aforementioned findings. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OTSEGO, MINNESOTA THAT the findings of fact outlined herein are adopted and the application for Site and Building Plan Review is approved based upon the foregoing information and applicable ordinances, subject to the following conditions: 1. All written and graphic materials officially submitted to the City shall be treated as a formal agreement between the applicant and the City. Once approved, no changes, modifications or alterations shall be made to any plan detail, standard, or specifications without prior submission of a plan modification request to the Zoning Administrator for review and approval. 2. The property owner shall dedicate a right-of-way easement for the east 50 feet of Queens Avenue, subject to review and approval of the City Engineer. 3. The design and construction plans for access from Queens Avenue and off-street parking areas shall be subject to review and approval of the City Engineer. 4. A landscape plan shall be submitted as required by Section 11-19-2.B of the Zoning Ordinance and is subject to review and approval of the Zoning Administrator addressing: a. Planting a mix of evergreen and shade trees along lot lines abutting residentially zoning properties meeting the screening requirements of Section 11-19-3 of the Zoning Ordinance. b. Any landscape areas shall be irrigated in compliance with Section 5-2-8.C.2 of the City Code. 5. A photometric lighting plan shall be submitted and all exterior lighting shall comply with Section 11-16-6 of the Zoning Ordinance, subject to review and approval of the Zoning Administrator. 6. Any exterior storage of waste and recycling containers shall comply with of Section 11-18-4.0 of the Zoning Ordinance, subject to review and approval of the Zoning Administrator. 7. All signs shall comply with Section 37 of the Zoning Ordinance, subject to review and approval of the Zoning Administrator. 8. All utility issues shall be subject to review and approval of the Building Official. 9. All grading, drainage, and erosion control issues shall be subject to review and approval of the City Engineer. 10. If determined necessary by the Zoning Administrator, the developer shall enter into a Site Improvement Performance Agreement as required Section 11-9-7 of the Zoning Ordinance, subject to review by the City Attorney and approval of the City Council.
