No Yes, was held by Planning Commission 6 April 2026 BACKGROUND/JUSTIFICATION: The City of Otsego is proposing to construct a Well House - Water Treatment Plant on Lot 1, Block 2, Dara Glen. The construction of the utility facility involves rezoning the subject property from I-2, General Industrial District to INS, Institutional District reflecting the proposed City utility use of the property and consideration of a Conditional Use Permit for a government utility building within the INS District. A public hearing to consider the applications was held by the Planning Commission at their meeting on 6 April 2026 at 7:00PM. There were no public comments, and the public hearing was closed. The Planning Commission asked about the City’s overall water system plans, which Council Member Dunlap provided an overview of as a member of the Public Works Subcommittee. After discussing, the Planning Commission voted 6-0 to recommend City Council approval of the proposed actions. The construction of the utility facility involves rezoning the subject property from I-2, General Industrial District to INS, Institutional District reflecting the proposed City utility use of the property and consideration of a Condition Use Permit for a government utility building within the INS District. A public hearing to consider the applications has been noticed for the Planning Commission meeting on 6 April 2026 at 7:00PM. The Comprehensive Plan establishes that water utilities are to be provided for the purposes of accommodating anticipated growth with a compact, urban form with staged expansion polices to manage development, provide for a balance of residential use types, and increase commercial and industrial development. The City has adopted a Water 2 System Management Plan to facilitate long-range development of utility infrastructure to meet the service needs of existing and future users. The addition of water treatment facilities for the water system is being undertaken to improve water quality for all users. The Well House #3 – Water Treatment Plan project is an essential service necessary to implement the policies of the Comprehensive Plan in accordance with the Water System Master Plan. Zoning. The lot is zoned I-2, General Industrial District. The zoning of the property was established on 24 September 2007 with platting of Dara Glen concurrent with approvals for Kaleidoscope Charter School to the west. The I-2 District zoning reflects the guidance of the Comprehensive Plan for development of the subject property for industrial land uses. The City proposes to rezone the property to INS, Institutional District reflecting the proposed use of the property for City utilities. City utilities are allowed as a conditional use within both the I-2 and INS District. Requirements for allowance within the INS District is as provided for by Section 11-90-6.G of the Zoning Ordinance requiring approval of a Conditional Use Permit in accordance with Section 11-4-4 of the Zoning Ordinance. The Planning Commission and City Council must take into consideration the possible effects of the Zoning Map amendment and Conditional Use Permit with their judgment based upon (but not limited to) the criteria outlined in Section 11-3-2.F and Section 11-4-2.F of the Zoning Ordinance: 1. The proposed action's consistency with the specific policies and provisions of the Otsego Comprehensive Plan. Comment: The 2023 Comprehensive Plan establish that costs incurred for the provision of City services shall be financed by those who receive such service. This is implemented by reducing the risk of payment for the provision of the utility systems by non-users through utility phasing, identification of potential water revenue sources, establishment of realistic growth expectations, and adoption of a Capital Improvement Plan. The improvement of Well House #3 – Water Treatment Plant is consistent with the Comprehensive Plan, Water System Master Plan and Capital Improvement Plan. 2. The proposed use's compatibility with present and future land uses of the area. Comment: The subject property is guided for industrial use. There is an undeveloped industrial lot to the north and undeveloped parcel guided for Office uses to the east of the subject site. Kaleidoscope Charter School is located west of the subject property across Kalland Avenue, which has an underlying guidance for industrial use. The Kittredge Crossings subdivision is located to the south of the subject site and is separated by increased setback and proposed/existing stormwater basins and wetlands. The proposed. The proposed Well House #3 – Water Treatment Plant will not affect surrounding properties. 3 3. The proposed use's conformity with all performance standards contained within the Zoning Ordinance and other provisions of the City Code. Comment: The proposed municipal well will comply with the applicable requirements of the Zoning Ordinance and City Code. 4. Traffic generation of the proposed use in relation to capabilities of streets serving the property. Comment: The proposed use will not generate any traffic beyond service trips by Utilities Department staff, which is within the capacity of Kalland Avenue as a local industrial street. 5. The proposed use can be accommodated by existing public services and facilities and will not overburden the City's service capacity. Comment: The City has planned for development of the Well House #3 – Water Treatment Plant to provide service capacity in accordance with the Comprehensive Plan, Water System Master Plan, and Capital Improvement Plan. Structure. The proposed 5,900 square foot structure encompasses piping equipment and chemical storage for treatment of raw water drawn from Well House #3 located to the east at Lachman Avenue and 77th Street. The finished treated water is then pumped from the Well House #3 – Water Treatment Plant to the water towers for storage. Section 11-17-4.D.2 of the Zoning Ordinance requires institutional uses have exterior finishes of masonry or precast concrete panels having a surface treatment over a minimum of 65 percent of any elevation facing a public street and use of masonry materials, precast concrete, fiber cement, or other architectural paneling for 90 percent of the other elevations. The proposed structure uses precast concrete panels with a combination of limestone block and exposed aggregate finish. There is a horizontal metal panel surrounding the upper section of the structure above the interior piping area, and metal roof. The proposed exterior finish of the proposed building complies with the requirements of the Zoning Ordinance. Buildings within the INS District are limited to a maximum height of three stories or 40 feet. The proposed structure is one story and measures 24 feet to the midpoint of the pitched roof section. The height of the proposed structure complies with the limits established by the Zoning Ordinance. 4 Lot Requirements. Section 11-90-7.A.1 of the Zoning Ordinance requires uses within the INS District to have a minimum lot area of five acres unless reduced by Conditional Use Permit. There is no minimum lot width requirement within the INS District. The subject property is 2.5 acres in area. Allowance of the proposed use of the property for City utility purposes through approval of a Conditional Use Permit will be subject to compliance with applicable setback requirements. Setbacks. Section 11-90-7.B of the Zoning Ordinance requires that the utility structures be subject to the setback requirements shown in the table below. The proposed building complies with the setback requirements applicable within the INS District, indicating that the area of the lot is suitable for the proposed use. Kalland Avenue is constructed as a local industrial street. The proposed access is to be constructed with a concrete apron that is 30 feet wide. Section 11-21-6.C.2 of the Zoning Ordinance establishes that a street access for non-residential uses is limited to 24 feet in width unless approved by the City Engineer to allow for adequate turning movements. The interior drive aisle provide access to service doors on the west and south elevations of the proposed structure. The interior drive aisles are to be surfaced with asphalt include perimeter concrete curb as required by Sections 11-21-7.C and 11-21-7.D of the Zoning Ordinance. There are no designated parking spaces within the subject property, which will not be a staffed facility. There is sufficient space within the interior drive aisles for Utilities Department Staff monitoring the facility or performing maintenance to park without interfering with traffic on Kalland Avenue. The drive aisles are also designed to accommodate truck maneuvers within the site so as not to require backing off of or onto Kalland Avenue. The design and construction specifications for access and off-street parking areas are subject to review and approval of the City Engineer. Exterior Lighting. The submitted plans detail two exterior light fixtures at the service doors on the west elevation of the proposed building. The light fixtures must have a 90 degree horizontal cut-off to cast light at the ground, not towards Kalland Avenue. All exterior lighting is subject to review and approval of the Zoning Administrator. 5 Waste Storage. The site and building plans do not show a location for waste storage. If exterior storage is intended, plans for construction of an enclosure are to be submitted with application for a building permit for review by the Zoning Administrator for compliance with requirements of Section 11-18-4.C of the Zoning Ordinance. Grading. Plans for grading, drainage, and erosion control for development the subject property have been prepared. The side development includes a stormwater basin for management of stormwater runoff created by the impervious surfaces within the lot. No landscaping of the subject property is proposed beyond seeding for erosion control. A more detailed plan for low maintenance, low water natural plantings should be considered with input from the Zoning Administrator. All stormwater management issues are subject to review and approval of the City Engineer. Utilities. The utility facility is to be connected to the water system for import of raw water and export of finished water. The facility is also to be connected to the sewer system for waste disposal. All utility plans are to be subject to review and approval of the City Engineer. RECOMMENDATION Our office recommends approval of a Zoning Map amendment and Conditional Use Permit for development of Well House #3 – Water Treatment Plant. POSSIBLE ACTION Motion to recommend approval of a Zoning Map amendment and Conditional Use Permit for Well House #3 – Water Treatment Plant, subject to the following conditions: 1. Once approved, no changes, modifications or alterations shall be made to any plan detail, standard, or specifications for Well House #3 – Water Treatment Plant without prior submission of a plan modification request to the Zoning Administrator for review and approval. 2. The design and construction specifications for access and off-street parking areas shall be subject to review and approval of the City Engineer. 3. THE CONTRACTOR IS RESPONSIBLE FOR INFORMING ALL VISITORS AND/OR PERSONNEL ON-SITE OF THE POLLUTION PREVENTION MANAGEMENT MEASURES THE CONTRACTOR IS RESPONSIBLE FOR THE PROPER DISPOSAL, IN COMPLIANCE WITH MPCA DISPOSAL REQUIREMENTS, OF ALL HAZARDOUS MATERIALS, SOLID WASTE, AND PRODUCTS ON-SITE. THE CONTRACTOR SHALL ENSURE PESTICIDES, HERBICIDES, INSECTICIDES, FERTILIZERS, TREATMENT CHEMICALS, AND LANDSCAPE MATERIALS ARE COVERED TO PREVENT THE DISCHARGE OF POLLUTANTS. THE CONTRACTOR SHALL ENSURE HAZARDOUS MATERIALS AND TOXIC WASTE IS PROPERLY STORED IN SEALED CONTAINERS TO PREVENT SPILLS, LEAKS, OR OTHER DISCHARGE. STORAGE AND DISPOSAL OF HAZARDOUS WASTE OR HAZARDOUS MATERIALS MUST BE IN COMPLIANCE WITH MINN. R. CH. 7045 INCLUDING SECONDARY CONTAINMENT AS APPLICABLE. THE CONTRACTOR SHALL ENSURE ASPHALT SUBSTANCES USED ON-SITE ARE APPLIED IN ACCORDANCE WITH MANUFACTURERS RECOMMENDATIONS. THE CONTRACTOR SHALL ENSURE PAINT CONTAINERS AND CURING COMPOUNDS BE TIGHTLY SEALED AND STORED WHEN NOT REQUIRED FOR USE. EXCESS PAINT AND/OR CURING COMPOUNDS SHALL NOT BE DISCHARGED INTO THE STORM SEWER SYSTEM AND SHALL BE PROPERLY DISPOSED OF ACCORDING TO MANUFACTURE'S INSTRUCTION. THE CONTRACTOR SHALL ENSURE SOLID WASTE BE STORED, COLLECTED AND DISPOSED OF PROPERLY IN COMPLIANCE WITH MINN. R. CH. 7035. THE CONTRACTOR SHALL ENSURE PORTABLE TOILETS ARE POSITIONED SO THAT THEY ARE SECURE AND WILL NOT BE TIPPED OR KNOCKED OVER. SANITARY WASTE MUST BE DISPOSED OF PROPERLY IN ACCORDANCE WITH MINN. R, CH. 7041. THE CONTRACTOR SHALL MONITOR ALL VEHICLES ON-SITE FOR LEAKS AND RECEIVE REGULAR PREVENTION MAINTENANCE TO REDUCE THE CHANCE OF LEEKAGE. EXTERNAL WASHING OF TRUCKS AND OTHER CONSTRUCTION VEHICLES AND ENGINE DEGREASING ARE PROHIBITED AT THE CONSTRUCTION SITE. THE CONTRACTOR SHALL ENSURE NO WASHOUT WASTE CONTACTS THE GROUND AND BE PROPERLY DISPOSED OF IN COMPLIANCE WITH MPCA RULES. THE CONTRACTOR SHALL INCLUDE SPILL KITS WITH ALL FUELING SOURCES AND MAINTENANCE ACTIVITIES. SECONDARY CONTAINMENT MEASURES SHALL BE INSTALLED AND MAINTAINED BY THE CONTRACTOR. THE CONTRACTOR SHALL ENSURE SPILLS ARE CONTAINED AND CLEANED UP IMMEDIATELY UPON DISCOVERY. SPILLS LARGE ENOUGH TO REACH THE STORM WATER CONVEYANCE SYSTEM SHALL BE REPORTED TO THE MINNESOTA DUTY OFFICER AT 1.800.422.0798. FINAL STABILIZATION: THE CONTRACTOR IS RESPONSIBLE FOR ENSURING FINAL STABILIZATION OF THE ENTIRE SITE. WHEREAS, the City of Otsego (“Developer”) is proposing development of City owned property as a water utility facility; and WHEREAS, the legal description of the subject property (“Property”) is attached as Exhibit A; and WHEREAS, the Property is within the West Sewer District and guided for future Industrial land uses by the 2023 Comprehensive Plan; and WHEREAS, the subject property is zoned I-2, General Industrial District; and WHEREAS, the City is proposing amendment of the Zoning Map to designate the property as INS, Institutional District; and WHEREAS, the proposed Zoning Map amendments is processed in accordance with the provisions of Section 11-3-2 of the Zoning Ordinance; and WHEREAS, the City is proposing a Conditional Use Permit related to improvement and use of the Property for City utility purposes; and WHEREAS, the proposed Conditional Use Permit is processed in accordance with the provisions of Section 11-4-2 of the Zoning Ordinance; and WHEREAS, the City Council must take into consideration the possible effects of the Zoning Ordinance amendment and Conditional Use Permit with their judgment based upon (but not limited to) the criteria outlined in Section 11-3-2.F and 11-4-2.F of the Zoning Ordinance, respectively: 1. The proposed action's consistency with the specific policies and provisions of the Otsego Comprehensive Plan. Finding: The 2023 Comprehensive Plan establish that costs incurred for the provision of City services shall be financed by those who receive such service. This is implemented by reducing the risk of payment for the provision of the utility systems by non-users through utility phasing, identification of potential water revenue sources, establishment of realistic growth expectations, and adoption of a Capital Improvement Plan. The improvement of Well House #3 – Water Treatment Plant is consistent with the Comprehensive Plan, Water System Master Plan and Capital Improvement Plan. 2. The proposed use's compatibility with present and future land uses of the area. Finding: The subject property is guided for industrial use. There is an undeveloped industrial lot to the north and undeveloped parcel guided for Office uses to the east of the subject site. Kaleidoscope Charter School is located west of the subject property across Kalland Avenue, which has an underlying guidance for industrial use. The Kittredge Crossings subdivision is located to the south of the subject site and is separated by increased setback and proposed/existing stormwater basins and wetlands. The proposed. The proposed Well House #3 – Water Treatment Plant will not affect surrounding properties. 2 3. The proposed use's conformity with all performance standards contained within the Zoning Ordinance and other provisions of the City Code. Finding: The proposed municipal well will comply with the applicable requirements of the Zoning Ordinance and City Code. 4. Traffic generation of the proposed use in relation to capabilities of streets serving the property. Finding: The proposed use will not generate any traffic beyond service trips by Utilities Department staff, which is within the capacity of Kalland Avenue as a local industrial street. 5. The proposed use can be accommodated by existing public services and facilities and will not overburden the City's service capacity. Finding: The City has planned for development of the Well House #3 – Water Treatment Plant to provide service capacity in accordance with the Comprehensive Plan, Water System Master Plan, and Capital Improvement Plan. WHEREAS, the Planning Report dated 1 April 2026 prepared by the City Planner, The Planning Company LLC, is incorporated herein. WHEREAS, the Planning Commission conducted a public hearing at their regular meeting on 6 April 2026 to consider the application, preceded by published and mailed notice; based upon review of the application and evidence received, the public hearing was closed and the Planning Commission recommended by a 6-0 vote that the City Council approve the request based on the aforementioned findings. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OTSEGO, MINNESOTA THAT the findings of fact outlined herein are adopted and the applications for Planned Unit Development – Conditional Use Permit and preliminary plat are approved based upon the foregoing information and applicable ordinances, subject to the following conditions: 1. Once approved, no changes, modifications or alterations shall be made to any plan detail, standard, or specifications for Well House #3 – Water Treatment Plant without prior submission of a plan modification request to the Zoning Administrator for review and approval. 2. The design and construction specifications for access and off-street parking areas shall be subject to review and approval of the City Engineer. 3. All exterior lighting shall be subject to review and approval of the Zoning Administrator. 4.
