AGENDA ITEM DETAILS RECOMMENDATION: City staff recommends the City Council approve two Common Interest Community plats. ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No No BACKGROUND/JUSTIFICATION: Boyd Dollansky LLC is continuing with development of the Condo Suites of Otsego as the industrial element of the Zachman Meadows plat. The industrial portion of the project consists of 14 separate buildings located on individual lots within a surrounding baselot. The developer is proposing a Common Interest Community (CIC) plat to provide for separate individual ownership of units within each building as a condominium association. Approval of a Common Interest Community plat is processed in accordance with Section 10-5-4 of the Subdivision Ordinance. Review of a Common Interest Community Plat is not required by the Planning Commission. City staff have reviewed the proposed Common Interest Community plats and condominium declarations and bylaws and determined that they are in compliance with the City Code and state law. No new public improvements are proposed with the Common Interest Community Plats, therefore no development contract is required.
