ORDINANCE NO.: 2025-11
ORDINANCE AMENDING THE CITY CODE REGARDING ADMINISTRATIVE SUBDIVISION APPEALS.
THE CITY COUNCIL OF THE CITY OF OTSEGO DOES HEREBY ORDAIN:
Section 1. Section 10-4-4.1) of the Subdivision Ordinance (Administrative Subdivisions) is hereby
amended to add the following provisions:
3. Appeal:
a. A denial of an administrative subdivision request by the Zoning Administrator
may be appealed to the City Council by the subdivider or property owner within
thirty (30) days after the making of the order being appealed.
b. The subdivider or property owner file with the City Clerk a notice of appeal stating
the specific grounds upon which the appeal is made.
C. Any appeal filed shall be comprehensive and include all matters subject to
question. Subsequent appeals filed by the same individual or group which are
intended to cause unjustifiable delay in the decision making process shall not be
accepted by the Citv.
d. The filing of an appeal shall be accompanied by a fee as provided by section 3-1-
2 of this Code.
e. The City Council shall make a finding of fact and its decision by resolution within
sixty (60) days from the date upon which the City received the appeal.
f. All decisions made by the Citv Council regarding an administrative subdivision
shall be final, except that any aggrieved person shall have the right to appeal
within thirty (30) days after delivery of the decision to the appellant. to the
District Court in Wright County. Any person seeking judicial review under this
section must serve the City and all necessary parties, including any landowners.

Section 2. This Ordinance shall become effective immediately upon its passage and publication.
