AGENDA ITEM DETAILS RECOMMENDATION: City staff recommends the City Council approve an amendment of the Subdivision Ordinance. ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No No BACKGROUND/JUSTIFICATION: The City Council approved amendments to the Subdivision Ordinance at its meeting on 10 November 2025. The amendment addressed comprehensive revisions of the administrative subdivision provisions. The City Council discussed the need to include an appeal process that would not involve the subdivider having to apply for a preliminary and final plat. City staff have drafted language to be added to the administrative subdivision process to include an appeal being made to the City Council to approve an administrative subdivision. The proposed language mirrors the process established by the Zoning Ordinance for appeal of administrative actions. City staff provided notice in accordance with Minnesota Statutes 415.19, Subd. 2 of the proposed Ordinance amending the Subdivision Ordinance 10-days in advance of City Council. BUDGET INFORMATION FUNDING: BUDGETED: N/A N/A 1 CITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA ORDINANCE NO.: 2025-11 ORDINANCE AMENDING THE CITY CODE REGARDING ADMINISTRATIVE SUBDIVISION APPEALS. THE CITY COUNCIL OF THE CITY OF OTSEGO DOES HEREBY ORDAIN: Section 1. Section 10-4-4.D of the Subdivision Ordinance (Administrative Subdivisions) is hereby amended to add the following provisions: 3. Appeal: a. A denial of an administrative subdivision request by the Zoning Administrator may be appealed to the City Council by the subdivider or property owner within thirty (30) days after the making of the order being appealed. b. The subdivider or property owner file with the City Clerk a notice of appeal stating the specific grounds upon which the appeal is made. c. Any appeal filed shall be comprehensive and include all matters subject to question. Subsequent appeals filed by the same individual or group which are intended to cause unjustifiable delay in the decision making process shall not be accepted by the City. d. The filing of an appeal shall be accompanied by a fee as provided by section 3-1- 2 of this Code. e. The City Council shall make a finding of fact and its decision by resolution within sixty (60) days from the date upon which the City received the appeal. f. All decisions made by the City Council regarding an administrative subdivision shall be final, except that any aggrieved person shall have the right to appeal within thirty (30) days after delivery of the decision to the appellant, to the District Court in Wright County. Any person seeking judicial review under this section must serve the City and all necessary parties, including any landowners, within the thirty (30) day period defined above. Section 2. This Ordinance shall become effective immediately upon its passage and publication. NOTICE IS FURTHER GIVEN that the ordinance adopted by the City Council amends the Subdivision Ordinance providing an appeal process for administrative subdivision procedures.
