BACKGROUND/JUSTIFICATION:
Modern Construction of Minnesota, Inc. received City Council approval on 9 June 2025 of a PUD Development Stage
Plan and preliminary plat for a mixed-use development of 13.80 acres located east of TH 101 and south of 90th Street
to be known as “Otsego Waterfront District”.
Section 11-36-4.D.6 of the Zoning Ordinance requires that a final plat must be applied for within six months from the
date the City Council grants PUD Development Stage Plan approval or the approval is deemed to be null and void and
expired. Upon request by the applicant, the City Council, at its discretion, may extend for not more than six (6)
months the filing deadline for any final plan when, for good cause shown, such extension is necessary.
The developer is requesting such an extension. City staff is aware that the developer is seeking to secure financing
through the Federal Department of Housing and Urban Development and working through the steps of that process.
Circumstances in the area for which the project was approved have not changed and there have not been changes to
the Comprehensive Plan or Zoning Ordinance that would affect the proposed development. City staff recommend
extending the deadline for submission of a final plat application an additional six months to 9 June 2026.
