No No BACKGROUND/JUSTIFICATION: Boyd Dollansky, LLC received City Council approval of a PUD Development Stage Plan and preliminary plat on 22 April 2024 to develop single family villa lots and 160,200 square feet of multiple tenant office/warehouse space within 14 buildings plus an office/clubhouse to be developed within the property to be known as “Zachman Meadows and Condo Suites of Otsego”. A final plat of the entire development was approved by the City Council on 12 August 2024. Subsequently, the Zachman Meadows Condo Suites plat was approved on 10 February 2025 to provide for an expansion of one of the industrial buildings. The developer is now proposing an amendment to the approved final plat to further subdivide Lot 1, Block 2, Zachman Meadows Condo Suites into two lots. Lot 1, Block 2, Zachman Meadows Condo Suites is the base lot encompassing common open space between individual buildings within the industrial portion of the development. The purpose of the proposed final plat is to allow for establishment of separate CIC associations within the development. • Comprehensive Plan. The 2023 Comprehensive Plan guides the subject site for industrial land uses to promote development of businesses that expand the City’s tax base and increase employment opportunities. The proposed development consists of 124 multiple tenant office/warehouse spaces that could be rented or purchased by small businesses as a location for their operation. This type of use was discussed by the Planning Commission during the Comprehensive Plan process as desirable for the City to provide a unique opportunity f or service and trade type businesses that also provides an option for relocation of existing home-based businesses. The proposed replat adds two additional tenant spaces. • Zoning. The property is zoned PUD, Planned Unit Development District to allow for the range and mix of different uses and performance standards specific to the development. The PUD District for the subject site is based on the allowed uses and standards of the I2, General Industrial District. The I2 District allows for multiple tenant buildings with a range of office and industrial type uses. The proposed replat does not affect the zoning of the subject property. The proposed final plat does not affect the use of the property. • Surrounding Uses. The table below summarizes existing and planned land uses in the area surrounding the property: The proposed final plat will remain compatible with existing and planned land uses surrounding the property. For the industrial uses, the PUD District requires those setbacks established by Section 11-86-7.C of the Zoning Ordinance within the I2 District to be setback a minimum of 30 feet. All other setbacks are defined by the building code for separation between buildings and the minimum 20 feet from the wetland buffer required by Section 11-16-5.F of the Zoning Ordinance. The proposed final plat does not affect compliance with setback requirements. ▪ Utilities. The subject site is within the West Sewer District designated by the 2023 Comprehensive Plan. There are trunk sewer and water utilities have been constructed to serve the proposed development. The proposed final plat does not affect installation of utilities to the buildings. The developer has paid Utility Availability Charges at the time of final plat approval. Utility Connection Charges based on occupancy of the industrial buildings or tenant spaces is determined and paid at the time a building permit is issued. The replat does not affect the utility plans or cause need for additional Utility Availability Charges. • Grading Plan. The City Engineer has approved final grading, drainage, and erosion control plans. The developer paid a Stormwater Impact fee for Otsego Creek at the time of final plat approval. The proposed final plat does not affect the approved grading, drainage, and erosion control plans. • Easements. There are existing drainage and utility easements recorded over portions of the property related to trunk sewer and water utilities. The proposed final plat does not affect existing drainage and utility easements previously dedicated. ▪ Outlots. The proposed final plat involves only Lot 1, Block 2, Zachman Meadows Condo Suites. No new outlots are being created with the proposed replat. ▪ Park Dedication. The developer paid park dedication fees at the time of final plat approval. The proposed final plat does not require additional park dedication. ▪ Development Contact. The developer executed a development contract for the initial final plat as approved by the City Council. The replat remains subject to the provisions of the development contract and does not require an amendment or addendum to the development contract. The legal description of the property is Lot 1, Block 2, Zachman Meadows Condo Suites, City of Otsego. B. The property lies within the West Sewer District and is guided Industrial land uses by the 2023 Otsego Comprehensive Plan. C. The property is zoned PUD, Planned Unit Development District. D. The City Council approved a PUD Development Stage Plan and preliminary plat on 22 April 2024. E. The City Council approved a final plat on 25 February 2025. F. The applicant is proposing to replat the subject property to subdivide the subject property into two lots. G. The Request for Council Action dated 28 July 2025 prepared by the City Planner, The Planning Company LLC, is incorporated herein. DECISION: Based on the foregoing information and applicable ordinances, the request is hereby APPROVED, subject to the following conditions: 1. The final plat shall be subject to the PUD Development Stage Plan and stipulations thereof approved by the City Council on 12 August 2024. 2. The final plat is subject to the terms and conditions of the Development Contract executed between Boyd Dollansky, LLC and the City recorded with the Wright County Recorder as Document A1560625.
